Hello everyone!
Great site, thanks for the great contributions!
For the last week or so I browsed this site and others trying to find the answer to one Q, but no result.
Are airline ticket and boarding pass accepted as proof for inspection at POE? The passport and I94 _STOLEN! :(

P.S. This info is necessary for AOS thru marriage with USC

You can file USCIS Form I-102 for a duplicate I-94 but if USCIS is doing their job properly, your I-94 should be in your file which the interviewing officer will have. I would certainly get the passport replaced ASAP. An airline ticket and boarding pass only shows that you flew into the country -- it doesn't prove that you were properly inspected at the POE. If you have a copy of the passport with visa and/or I-94 that will certainly help.

Yes, I agree with everything that Kitkat1 said: file for the replacement I-94 and for sure get a new passport.

One thing that our lawyer told us is that you cannot be expected to have all/every paperwork that would prove your case. The more documentation that you have of course the better off you are. I would think that a boarding pass and ticket would be pretty good forms of proof. Did you file a police report for the theft? Do you have copies of your passport?

You would definitely make your best case of explanation and then show what you have. We have used expedia files of purchase of tickets also. The more paperwork you have to prove your claim the better off you will be. If you don't have what they ask for and have tried your best to get it, you explain why you do not have what they want, present what you have and make your best case.

Yes, have the theft report from 5-0 and a copy of the passport.
Unfortunately, no copies of the visa or I94 exist(guess I'm not as smart as I thought I'm)

Don't know if this detail bears any positive weight in my case, but I arrived on LAX on Swiss , i.e major POE and major airline. I know that this still doesn't proof the point that I was inspected (technically speaking!), but how does one goes around inspection on L.A. Airport? I would think pretty much is an impossibility. I mean, one gotta be pretty coo-koo to even think of trying such a stupid stunt. If nothing else works in my favor, I'm planning of throwing this point at them.

Final question about this matter:
Is there a time limit on filing for an I94 replacemennt?

Boy I have to agree with you on that one...I don't know how anyone gets around inspection at LAX... I think your best bet is to present everything that you have and make the strongest case that you can.

I don't know the answer to this...but my guess would be no. Have you filed for the replacement? If not it would certainly be worth a try and I think even if you do not get an answer to your request before your appt., the fact that you have documents proving your application for the replacement should also bolster your case. http://www.uscis.gov/files/form/i-102.pdf

We wrote to US Customs Enforcement because immigration wanted it in 30 days. They responded to us in 37 days, we hand delivered it before they came to a decision, and Customs did not charge us any thing. You may also want to due this if you are in a hurry.

But you should also request for the I-94 replacement but it will take time (3 to six months) We are still waiting on this and we filed it Nov 5, 2006 but we put down the wrong year and had to write them back.

We were denied and offered to refile, want to be prepaired when we do it again.

Jazzette - were you denied because you failed to prove the legal entry? We are in the same boat - lost passport and I-94 - and I am terrified that we will be denied. Do you have to file all of the paperwork again? Fees and all?
