1. With having Domestic Violence and DUI more than 7 years ago, can my husband be approved for a waiver? Or will he be put on backlog? Or just flat out denied?

Can you clarify what the charges were... was the domestic violence charge a felony? What was it for?

Will you be processing through Mexico?

OMG you got me there becasue I have no clue if it was charged as a felony. I've been trying to find out becasue it was long time ago. And of course my husband does not remember. That happened becasue his girlfriend said he hit her. I will be doing this through Mexico.

Okay, that helps. I will ask Laurel tomorrow, but I think you need to find out if it was a felony.

My unprofessional opinion, just an opinion, is that your husband will not be found "clearly approvable" through the pilot program unless you have some really exceptional hardships. I'm not saying he will be denied the waiver, just that he will probably be put into the backlog.

I'm not sure how a felony affects things. I thought it meant no eligibility to the waiver in some cases, but I will ask Laurel tomorrow.

Hi. At my husbandīs first appt. they carefully reviewed him misdemeanor arrests, several, all from more than 10 years ago, and did not even check the criminal box on the infopass appt. form, only the illegal presence box. They said he did not need to prove the criminal resolutions again as that was finished. I do not know if that is accurate as it seems everything varies so much in CDJ but we are hoping for a visa this month! Isnīt everyone? Good luck. I am curious as to Laurelīs answer to the question also.

JT - if they check that criminal box on the appt. form it can mean that he is ineligible for a waiver based on those crimes. A few misdemeanors does not make a person ineligible for the waiver, but it may affect the likelihood their waiver will be approved, and particularly whether it will be found "clearly approvable" during the Infopass appointment. Does that make sense?

Hi I also won't be able to make it and would really appreciate it if the following question could be asked for me -

"My husband had a misdomeanor charge in High School when he was 17 - stupid stuff like writing on the bathroom walls at school - it was a charge of Vandalism.. It was not an arrest .. They gave it as a traffic ticket.. I can not seem to find whether or not this is actually a Crime Involving Moral Turpitude or not. Even if it is, from what I have read he is cleared because he was under the age of 18 and it has been 5 years since charged and completed the community service.. Is this true? What can we expect from the interviewer? Will this cause him to be sent to the backlog? He also has ONE other ticket for driving without a license which has been paid and other than that he is 100% clean.."
