can someone help me?where do i go to get the forms to file for a fiance visa? is it a package that explains what will be needed?

what is an INFOPASS??. i downloaded the forms from the website. i will fill them out and then send it to the address that the form says to send it to. then what? will i get notified when they get it? do i need an appoinment with anyone before i send this stuff? and one more thing....in order to prove i know him fpr two years can i send real dated photos? someone please help me..thank you

Have a read of the Guide to filing the I-129F petition that I linked in my post above. It gives a great outline of what you need to submit. It also contains lots of links to various resources that answer questions on many things such as 'original documents', 'signature requirements', 'Answering Q18 and evidence submitted to show that you have met within the required 2 year period', and much much more.

Regarding your question on photos as evidence, it can be risky relying soley on photos, as they can be looked on as secondary evidence. Do you have boarding passes, hotel receipts, things like that? Whilst some only submit photos and have been approved, many also have received an RFE for further evidence. Make your case is as strong as possible from the outset.

What type of evidence and how much evidence should I send to show that we have met within the required two year period prior to filing the petition?
Tip:
Use Q18 of the I-129F petition to describe in some detail of how you met in the required 2 year period that established the relationship. The evidence you then submit should support those details. Boarding passes, passport stamps, hotel/credit card receipts, rental receipts if ever lived together etc etc are primary evidence. Photos are secondary which support the primary evidence. What one should be aiming for is creating an image in the minds eye of the adjudicator......a complete picture. Look outside the box for evidence that shows you both in the same place at the same time. Each case is different and one should submit evidence accordingly, not just rely on the standard unofficial list.

Whilst evidence of an ongoing relationship is not a requirement at the initial filing stage, it can be beneficial to those from high fraud countries (eg the philipines) to do so, or if there is anything that could be a red flag that may cause issues at interview stage. This evidence should always be very carefully scrutinised especially emails & chat, to make sure there is nothing mentioned that may be construed in a different way then it is meant. Also make sure that any photo evidence submitted of any ceremony cannot be mistaken for a marriage ceremony which has in the past caused issues and denials.

VisaJourney.com really helped me out a lot. Depending on where you live depends on how fast your I-129F will be processed. If you're going though the Vermont Service Center, you are in luck.

Thank you very much guys for all your help. but i do have one more question. i will be filing in the next few days..is that automatically considered a pilot program or is the pilot program available if you get denied and then qualify for a 601 waiver. i dont understand it.

Once your I129F is approved then your case will get forwarded to the National Visa Center. After completing all forms through the NVC your case is then forwarded to the consulate in CDJ. They will schedule you for a visa interview, where if denied for the inital visa, and qualifies, will become eligible for the pilot program.

Fiance visa appointments aren't scheduled. Once the approved petition is forwarded from the service center to the NVC and then to the consulate, they will enter all of your fiance's information and send each of you a fiance packet. All the same information is also available on their website. Once you have all of the forms ready and have received the official letter from them, your fiance can get his medical appointment and the next day go for an interview -- fiances have an open interview appointment and can go when they are ready.

If you are submitting a 601 waiver, once you know what date he'll go to his interview, you will schedule a 601 waiver submission appointment for a few days later via the infopass appointment online. This is several months down the road and there isn't much reason to be concerned about making the actual appointment right now, although you should begin to work on your hardship letter and start gathering evidence and proof to support your hardship arguments now.

You should really read the guide posted by aussiewench as well as the information on the CDJ website before you file a petition so you understand exactly what needs to be provided with the intital fiance visa petition. There is also a thread on visajourney in the foreign embassy forum specifically about Ciudad Juarez and fiance applicant's experiences (separate from waivers).
