Hi, this is my first post here but i have been reading all the previous post; my ? is my husband has his visa appt in cdj 11/8; we are preparing for the
I-601 and infopass appt; however i am reading and researching more and i am concerned about a previous problem he had; i dont know all the details but he ewi approx 1995 and was picked up in 1996 by ice and dropped off across the border; he said he had only his thumbprint taken but he doesnt even really know because he said there was no translator there; my ? is would this block our I-601 and apply to the 212(a)(9)(c); he reentered the same year 1996 - ewi again; our attorney seems not to be concerned and thinks we should proceed with the appt; I am unsure; any advice is appreciated

You will be fine reguarding unlawful presence and eligibility to file the waiver. 9c is triggered when someone accumulates more than 1 year of unlawful presence after April 1997 and then departs (or is removed) from the US and then subsequently re-enters or attempts to re-enter. Even if your husband was actually deported in 1996, he is fine because his subsequent re-entry was before 1997!
