I am new here, husband is from oaxaca. I have been reading the posts and have found quite a bit of information on how to get the process started.:thumbup:

Could you tell us more about your story. For example, did your husband EWI (entered w/o inspection)? Has he been deported? Where is the process are you? Does he have a criminal history (for example, DUIs, Drugs, ect)?

My husband EWI in 2003. He has been arrested one time for DUI. "lesson learned" we met at work and married December 0f 2006. I am scared to death to start this process because I know we are going to have to spend time apart. I am worried that it could drag out for years and we are going to have a hard time financially making it without each other. I have a small child with muscular dystrophy that I have primary custody of. So I dont see myself moving to mexico to be with him permanately. Do you think because of his arrest we would be approved for the 601 waiver everyone talks about.

It might delay you but it should still be ok?
From what I can tell it has to be 3 years since the DUI and he has to show that he is 'rehabilitated' and they will probably make him talk to a counselor..
He more than likely will get sent to the backlog for processing, but even that should only take 6months-1year that you will have to be separated.. by that time maybe it will be shorter! (lol we can hope)

Hello you have come to the right place..I am also fairly new and have found a lot of answered questions here that other people could not answer for me.My husband is from coatzacoalcos veracruz, and we are currently living in florida about 30 min. from tampa.. If the DUI is more than three years old when you go to your appointment, it should not really be a factor. I just asked this question of Laurel and she thought that pilot program approval would be possible even with DUI or DWAI as long as it was over three years ago. You mentioned a child with Muscular Distrophy? That is an excellent hardship and as long as you attach good evidence to your HSL, you should have no problem getting approved, probably through the pilot program (no separation)! Hurry up and file!
