Well, after the disappointment in the Senate for not reaching an immigration deal... we've just received my hubby's interview date in CDJ, August 27. We have an appointment with a lawyer on July 16 but I was hoping to get some info prior. Other than the waiver, is there any rule or exception if he came here as a child? My hubby has been here since he was 11 and would be really lost if he were to have to stay in Mexico. Also, any other advice is greatly appreciated.
Thanks!

The only thing that might apply to him is that illegal presence before the age of 18 doesn't count. But if he has been in the US for more than one year after he turned 18, he'll still be facing the 10 year ban. If you have a well prepared and strong hardship letter/evidence, and the waiver is "clearly approvable" you'll be submitting it through the pilot program and he should be ready to go home within a few days (depending on how long after your initial appointment your infopass appointment for waiver submission is scheduled).

Smellycat -- Don't worry. Things are so much better for applicants in Ciudad Juarez now than they were even a year ago.. as long as you can put together a good waiver packet, he should get approved right away.

Are you familiar with the Infopass appt you need to make to turn in the waiver a couple days after your interview?

Have you read the information about writing the hardship letter?

Make sure, if you do hire a lawyer, that they are experienced with I-601 waivers. A lot are not, and if that is so, you might as well do it yourself with the information from this site. (cheaper and better than a lawyer who doesn't know how to write an extreme hardship brief).

There are only a few people who have applied recently through the pilot program on this site who were not immediately approved, and most of those had criminal stuff in the background.

Good luck!

Hi girls,
Yesterday I came accross Laurel's post on the juarez forum regarding the pilot program (http://www.smf.juarez-mexico.com/index.php?topic=503.0)
On the infopass appointment, this is what she posted:

Warren: "This new pilot program will utilize the InfoPass appointment system. When an immigrant is advised by a CO that s/he is inadmissible and a waiver is available, s/he will be given a notice from USCIS advising them to make an appointment in InfoPass when they are ready to file the I-601. The letter also clearly outlines the need for supporting evidence to meet the applicant's burden to demonstrate "extreme hardship" to their spouse or parent."

Laurel Scott recommends that you make your infopass appointment 2 to 3 days after your interview. You need to make this appointment before you go to the interview!
To make your infopass appointment click the following link:
https://infopass.uscis.gov/info_en.php

This is from Laurel Scott:
To make the infopass appointment, go to USCIS.gov and click on the infopass icon on the bottom left. Most of the instructions are clear and easy to understand, but there are a few confusing things.
1. After you click on the "Make your Appointment" icon a page will pop up asking you to put in your zip code or choose from a drop down menu. Lots of people erroneously put in the zip code of the petitioner. That's wrong. You need to go to the drop down menu and choose Juarez.
2. Click on the second choice to make a 601 appointment.
3. On the next page, they will be asked for an alien number and a receipt number. If you don't have an alien number, just leave that blank. Put the consular case number (starts with CDJ) in the space for the receipt number, NOT the receipt number for the I-130 or I-129F.

Hope this helps!

Cathryn,

I'm not sure but maybe when you are trying to schedule your info pass on the drop menu are you putting "United States" if thats the case that is why it won't let you see appointments, you need to put Ciudad Juarez Mexico.

I just had my first appointment on June 13th and I scheduled my info pass before I left because I didn't want to run the risk of leaving with out one. I scheduled it for the next day. Most people recommend you wait a day between your 1st appointment and your info pass, to be on the safe side.

Like I said my 1st appointment was the 13th and they told me I qualified to file and I601 waiver. I knew that before hand so I left with my packet in hand. My info pass was on the 14th. I showed up, immediately was sent to pay the fee, then I was sent back to building "C" window 13. I turned in my HSL and within 30 minutes I was called back up and told I was approved. Then they sent me to building "B" again where I waited for 5 hours for my Visa. I didn't mind though because I left with a Visa in hand the same day!
