For a one-time EWI .... Yes or No??
"Have you ever been refused admission to the U.S., or been the subject of a deportation hearing or sought to obtain or assist others to obtain a visa, entry into the U.S., or any other U.S. immigration benefit by fraud or willful misrepresentation or other unlawful means?"
I'm thinking yes, but my fiance was not deported nor did he try to obtain a visa, however did obtain entry into the US but not with fraud or misrep.

The question asks if he ever tried to enter BY FRAUD OR MISREP - the answer is NO unless he was ever charged with fraud or misrep.
The only question he would answer YES is Q. 38: "Have you ever been unlawfully present in the US"

Sooo funny how things work out. I remember we were days apart with the I-129F and even with a couple of delays, you still beat me! :curse: ha ha, I kid ,I kid! I am so happy for you and your fiance. Good luck with the wedding preparations!

Question #29) Have you ever been in the US, when & for how long?
I just right the entry date of EWI and # of years?
Question #31) Have you ever been refused a U.S. Visa? Yes/ No
Due to EWI my fiance was found ineligible for the K-1 visa but filed the I-601, so technically was he refused the K-1 visa?

I had trouble with both of those questions too! For #29 I put the date of his original entry and how long he stayed. For #31 I put yes...on that one I had to do a bit of research. Basically you must enter yes for any visa refusal, even if a waiver was filed. So I put yes and the date of our first appointment. Good luck!!

I put NO - might have been technically incorrect but it didn't cause him any problems at his pick up
