View Full Version : help regarding I-130 application for wife!!

My wife was in Canada as a foreign student visa when we got married against her families wish.And they cut her off after that and she couldnt renew her visa.As i am a US citizen i applied for her as soon as our marraige was registered.The process is still going on for one and half year and she still have no status at Canada.Now the immigration office send me a letter saying her application was approved at local office,now they will be sending letter to her regarding what she needs to do next.I understand they will be asking her of police clearance cerificate and medical examination.Since she is without status there what sort of problem we might face.And what is the way out of it.FYI her parent doesnt stay in the country she is citizen of which is India.They are staying in Australia,that was another reason she could not go back to india after her student visa wasnt renewed.she is worried sick and so am i.Please help.

Is she going to be attending an I-130 interview in Canada?
I would think that you might need to file an I-824???? to transfer the file to India. When she gets an interview date there, she would fly to India to attend the interview and hopefully get approved and come to USA quickly.

Laurel mentioned on one of her updates from the AILA conference mid June something about filing from the country where you were married. Of course this post is lost and I do not remember specifics or even if this would apply but it would sure be worth it to ask her in her chat next Wednesday.
Does anyone remember Laurel posting about this?

yes she will be attending her interview in canada.she doesnt have anyone at India right now where she could go and stay.I am in a prety bad situation help me as much as you can
