View Full Version : Anybody have an EWI relatives?

I just want to know how you all did? My story is that my husband is EWI, he's from Brazil.. He crossed the border of Mexico year 2000.. Caught and released... He got deported last year nov. 2006... We're married since 2003 and have a 3yr. old daughter. I'm USC since last year May 2006.. I have a lawyer processing his papers.. I'm living with my parents because I cannot afford to pay my mortgage.. I have a condo in Florida and will be in foreclosure.. I have a maintenance fee from that condo that need to pay.. They already sent me to an attorney for collection.. I have a credit cards, lawyers fee, and of course there's no free in the US... i still need to give some money for my parents for staying in their house.. and now i need to go to the psycologist because of depression..iIt's just crazyy!! I have a questions,.... 1st, does he need to have an interview first in Brazil before he file the waiver??? and do i need to be there on his interview?? This what my lawyer said to me... How long does this waiver takes??? I feel like I will be a while to know the answer for he's waiver... Pls. I need you'll help.. Thanks a lot....

You do not have to be present for the interview, but if you are there you will be included in the interview.

Brazil requires 2 interviews before they will allow you to file your I-601 and because he was deported you will also need the I-212.

At the first interview they will determine if you are eligible to file the waiver and make sure that your marrigage is a valid one. At the second interview ususally about 1 month later they will allow you to file your waiver package. They will then send your waiver package to Lima, Peru for adjudication which can take about 6 months. Lima will then send your approved waiver packet back to Rio at which time you will be given a third interview date in Rio to pick up your visa. They also will allow you the option of leaving your passport at the Rio consulate at the second interview, or sending it into them and they they will mail it back to you. In this instance you will not have to return to Rio to pick up the visa stamp.

Some people are required to go to Rio before the first interview to be fingerprinted. This usually happens if you have prior experience with immigration, such as a deportation. If this is the case your first interview will be schedule about 6 to 8 weeks after you are fingerprinted. It takes about this much time for your fingerprints to be cleared through the FBI in Washington.

It sounds like you have a good start on hardships. There are a couple of approved hardship letters from Brazil on this site in the I-601 sticky section. http://immigrate2us.net/forum/showthread.php?t=59 The key to getting approved is not only having the hardships but being able to prove the hardships with good strong documentation. Good Luck to you. Has your lawyer any experience with waivers, especially through Lima?

He does a lot of different waiver.. but it looks like he's one of the popular lawyer in the area of pompano beach, fl.... he works with brazilian people.. and he does some of my friends cases who's brazilian..
I keep thinking and getting so depress for everything happening to me.. My daughter looking for him.. all she knows is her dad in brazil.. some of my friend's husband sometimes she call them dad.. and it really break my heart..
Thank you for you all answer.. if anybody knows like my situation and got approved in waiver pls post it for me... i know im not the only one in this situation, i just getting stress and depress about the bills in here and missing him so much..

Is anybody know about foreclosure? if you have a foreclosure, do u need to pay the attorneys fee.. the bank is the one who's gonna file the foreclosure so do i need to get charge on the attorney tha they hired? they sent me a letter and they said i'll be charge some other fees and attorney fees. what i know they just take the property and thats it. i dont know if they charge me about the attorney... i can't afford the mortgage to pay then they charge me the attorney fee.. doesn't make sense.. but if anybody knows about this post it too.. Thanks guys.. I hope and I wish my husband will come home soon. Pls. include us to you'll prayers. Thanks again!!

Why was your husband deported?

He have an interview last year november for I-130.. he's I-130 got approved that day but they detain him. He is EWI since 2000.. he have already a deportation hearing and didn't attend.. He was in detention facilities in texas and deported dec.11...

so, your husband had a deportation hearing prior to you filing for I-130 right?

My husband is EWI and also from Brazil, so you are not alone in this process.
