I was married to US citizen twice. First time entered via K-1 visa, got married but divorced ater 1 year. Then I met and married my current husband in 2002. Applied for AOS, I-130 approved but I-485 denied due to K-1 status. So I left US in late 2005 on voluntary departure. My husband re-petitioned for me to go back but not much constructive progress so far. And recently I start to realize that he might have found somebody else there based on his lack of communication. It is sad but I understand our difficult situation. He is still young and have needs. If he decides to move on I will set him free. Honestly speaking there are men (including US citizens) approaching me here but I am not dating anybody. I am having good opportunities here so have decided to focus on career advancement for now and do not intend to go back to US very soon. But sometimes I wonder, if ever I get married again with a US citizen (if that happens), would the chances be very slim to immigrate to US after 2 failed petitions? I understand they might look into the cases more carefully to make sure the marriage is not scam, but how often they would still say no even if there are sufficient evidences to prove the bona fide marriage? Please advise.

And FYI, I am not barred to re-entry. I was legally working and studying in US under AOS status.

should you decide to marry again and immigrate they will most likely look over your applications with a fine tooth comb. I know of a few people who were called into interviews with their spouses and interviewed separately as well before their application was advanced. If you have proof that your relationship is legitimate then it shouldn't be a problem. It might take longer to get everything done, but it is doable. Good Luck! :D

Not sure that you were in status, sounds like you were out of status in 2002 until 2005.

As far as I know filing to adjust status would not stop the clock when there was no basis to do so.

We filed for AOS in 2002, went through interview, told awaiting notice in mail and didnt get any reply until 2005. During the three years I was approved with I-751 and was working and paid my taxes. Consulted upon Laura Scott actually about the "bar" issue and she said that she would be very surprised if INS considered that period illegal. At least I hope so too.
