I married my husband in the states-why would you not be able to do so? Can you give us more information? did he overstay a visa or EWI?

I would say marry in your state. If not- there are always Las Vegas:thumbup:.
Congratulations

Yes, you can get married in the States... regardless of the status. It just depends on your State/County law on what kind of documentation(s) they need...i.e DL, BC, SSN, etc etc...

But ditto on Ginger, :) There's always LV....

We had to go to the social security office, have them take a look at my husband's name/driver's license (which was valid) and determine that he did not have a valid social security number to present to the city to marry. They gave him a letter that essentially said, "this person is not eligible for a social security number" and we took that to the courthouse to get the license. I'm sure each state is different, but many of us have married in the states to undocumented people.

You can get married in the US but you cannot submit the 601 in the US if he entered illegally. It doesn't matter where you live -- it that were the case, everyone would move to Boston to file their waivers.

We married in Indiana- they didn't even ask for a SS#. Kitkat is right, the I-601 will have to be filed in his home country or in a third country where he has legal residence. But you can marry in the US, sure.

Congratulations!

My opinion is that there are a lot of lawyers out there giving out false and damaging information. We've had several on this site over the past few days back that up.

Does he have any kind of ID? Chances are depending on what state it is, he is gonna need some type of ID to get married.

He is illegal. What country is he from?

We got married in Tahoe, I think he just had to show his passport, as he didnt have a ss# at that point.

I have more faith in the members on this site than any immigration lawyer (other than Laurel, who knows her stuff!). We are living the experiences, sharing our stories, getting valuable feedback, and supporting each other through the process.

Hi czech,
I'm also in MA. MA requires a medical/bloodtest so my husband was illegal and we just went to NH and got married to skip the BS. We went to a city hall in Hampstead and got a marriage license. Then, after that you can file I-130 to begin the process.
I still think he will have to leave though. I don't think Boston gets special treatment.
ha wish they did!
