I was wondering if anyone has had any experience with the conulate in San Jose Costa Rica???? I am still waiting for my I-129 to be approved at the Vermont service center (back logged like 6 months) and I just wanted to get an idea of how much time I am looking at??? Another question: can a fiance file a 601??? I mean I am going to need to cause my fiance has the 10 year bar due to an over stay and misrep. so i know we are going to get denied!!! is there any hope for us??

yes, i believe you can file for your fiance. :) (I'm sure others will correct me if I'm wrong...)
I'm not sure about filers with Costa Rica..need to check Pinkpig's excel s/sheet.

As for Central America, I know that Guatemala is pretty good, and I don't know about Honduras yet... there are a bunch of us who are filing there and are still waiting to find out. I think Honduras is pretty tough... let's hope Costa Rica is as good with approvals as Guatemala!
You can file the I-601 for your fiance! Just study the approved hardship letters on this website very closely. The key for getting the waiver approved is physical evidence... include evidence for EVERY hardship claimed in your letter!

is there any tpye of waiver to file to ask for forgiveness of the misrep??? or would that be what the 601 is for?? my fiance got approved for the H2b from CR then went back home and tried to get the H2b the following year..and that's when they saw that in 2000 he EWI....the guy was REALLY nasty to him and told him to try again in 90 years!!! aaaah

the I-601 takes care of everything... entering illegally, overstay, criminal record, misrep, etc. You will only need to file one waiver to take care of any and all inadmissibilities.
The only thing the I-601 doesn't take care of is a deportation. If there is a deportation on the record, you will need to file an I-212 simultaneously. Generally, if the waiver is approved, the I-212 is approved along with it.
PS-- that guy who made the "90 years" comment was a JERK! Where was he? The embassy??
