If for any reason your I-601 waiver is denied, you can appeal the decision. Of course, no one wants that outcome, so your best bet is to work hard on your hardship packet. Feel free to ask any questions, post your story, etc. and you will find tons of answers/support here to help you!

With all the help here there are many more positive ways to start your immigration process.
While the easy answer to your question is that if your hardship waiver is denied then you don't get to immigrate to the US, there are many more things to think about and work on positively before you even think of that outcome.

The I-601 process is very hard:waiting: on families and relationships:angryfire:. It is slow, and can be expensive.
But, in my case and for many others here (about 75% based on the statistics) it was rewarded with reuniting my family:family:.
I always really felt that I had enough hardships to make it, and that turned out to be the case. I hope you too can use the process (and the help on this site) to reunite, and not end up in the worst case scenario your question envisions.

My wife's I-601 was denied in Frankfurt. We used a lawyer and had a lot of problems. I refiled the I-601 with tons of help from people here on this site. Frankfurt allowed us to refile the I-601 and it's been refiled a month now. I believe that had I found this website earlier, it would never have been denied. Do your research, prepare a good HSL with every piece of evidence you can find. Post your HSL here on this site and you should get tons of help. I DID!!!! Think positve. Good Luck
