I came to usa on F1 VISA d/s STATUS.
i did not register for classes for 4th semester due to my finance problems.I stayed in the USA for 4 Months after my school terminated my F1 visa.I left to my home country after 4 months voluntarily.

After coming come from USA, i contacted school to rejoin and they said, there is FLAG in my SEVIS record.
I said the reason for overstay and school promised me for removal of FLAG in my SEVIS record.
I am hoping, flag should be removed.

Let us assume the FLAG is removed from my record.
I want to Visit USA in B2 tourist Visa in january nextyear( not F1 visa).

I KNEW, even then flag is removed from my SEVIS record, There will be information of overstay in sevis record which cannot be erased or overstayed?

Based on the above sentence,will the consulate officer in my home country deny my B2 VISA if there is record of overstay in my previous trip even though FLAG is removed from my SEVIS RECORD?


I also heard , that people with D/S staus will not accrue any unlawful prsence unless there is determination made by immigration judge on the case.

How, far the above sentence is liinked with my case?



Will i have any problem in getting toursi visa after my flag is removed?

Please anser my question if somebody can...It would be thankful.

Greetings! From what I understand from when I was on an F-1 that the SEVIS flag only dealt with your ability to receive and extend your F-1. How long did you overstay your visa? This cannot (again from what I was told) be erased from your immigration record so it might be difficult to get a toursit visa since you did not comply with the parameters of your F-1 visa and you have a track record of overstaying visas (not good in the eyes of the US). Did you notify the school when you did not return for your 4th semester? Do you have any record of contact with them that you would not be returning? What is your home country? Sometimes they have agreements with countires that can help your situation.

This is partially correct information. Both an Immigration Judge and CIS can make the determination that you failed to maintain your status. Either way, you don't accrue unlawful presence until the determination is made.

Yes, I notified the school that i will not be attending the 4th semester.That is why they terminated my F1 visa.

But, After few months of coming to india, I contacted school..School asked me explanation for 4 month overstay..I said reasons and school got convinced....

Today, I got mail from my school that my flag is removed....

I still want to know, will my chnaces of getting the tourist visa in the future will be down?

From my experiences, I was told that if I overstayed my visa I would have a difficult time getting valid entry into the US afterwards. But that was me. Can you call the consulate and ask a professional?

"AFTERWARDS" means for full future .....Or, I would get if they even reject me twice..like 50/50 chance depends on consulate?

If you are looking for definites then obviously I have no idea. But from what I was told when I was going through F-1 then told me it would be very difficult if I overstayed. But it is ultimatly up to the customs agent at the consulate who reviews your case.
