Hello to everyone!!
I just wanted to say hi to everyone and also let you know that i haven't receive any news from my I-601 in country it's been 2 years already and nothing. ( I filled for my husband)
Anyways at this point i really don't care anymore because we're separate and soon getting divorce, i'm so sad and depress that after all this immigration problem and all my support to him he never appreciate and end up paying me like this. I read that ukgirl27 got denied maybe ours too since were filled from Chicago too.
I really wish to all you luck and god take care of your families and relantionships.

Rossy :C

hey ladies, i have been in Dallas this weekend visiting a family i used to nanny for so sorry i have not got back to you! Well the update on me is that i have 30 days to appeal but after speaking to 3 lawyers and the congressmans office they all agree that we don't have any relative hardships and probably wouldn't win the waiver so i am leaving at the end of November to go back to the UK. My lawyer said that they won't come knocking on my door to get me to leave (just yet!) He said that i should be ok if i leave at the end of November so that is what i am doing. My husband does not want to move to England and we are going to separate.....This all really sucks but we both believe that things happen for a reason and we are fine with decision, well, as fine as we can be. I really can't imagine staying here and trying to do the appeal and being here without status for another 2 years...what happens if we have a baby and i still get denied? There is no way i am taking that risk!!!!!

Rossy, i will call you this week:)

if you refile the 485 you would be back in status as it's pending-no way to beef up the hardship letter? just hate to see you go through that separation...

The immigration officer told me that i need to get the I-601 approved before i re-file the I-485....this is all just a nightmare. My husband and i are going to see what happens and maybe try and re-file from the UK next year!

hhmmm, that's interesting and disturbing you can't file those concurrently (altho makes sense money-wise). maybe some miracle will occur between now and november! one can hope-good luck!

Rossy

I know i can appeal but appeals take around 2 years and i would still technically be out of status and not be allowed to work (the immigration officer told me this.) My Dad had a stroke earlier this year and even though he has made a 95% recovery i still want to go and see him and i can't wait another 2 years of not seeing him (he can't fly) plus i haven't seen some of my other family members for over 5 years.......we are probably going to try when i get back to London to file from there!

ukgirl27...just my 2 cents...

maybe you could refile your i-130 now, so it'll be in process. That way, once you're in the UK, you don't have to wait too long for your appointment. Plus, I think, counsular processing is faster than in country waiver.

Good Luck.

my I-130 is still good supposedly as it was already approved!

ukgirl27 - HOLY man....I so jealous of your situation....I know I should NOT be but its hard. I know your situation SUCKS and is HORRIBLE for you guy.....and that you would NOT wish it on anyone!!! BUT for us I feel you have the BEST of both world and yet seem to see the negative in your situation. I would do ANYTHING to have what you do.

I guess every situation is different but I know what we are doing is truly HORRIBLE. We have a 3.5 month old daughter and yet we are still living apart. I have NO criminal record of any kind, we truly "tried " to follow the rules but were given BAD advice and messed up. So NOW we are stuck apart for no real reason IMO!!!

wow, this is why we decided not to have children before we knew what would happen with immigration so we would not be in your position......this is why i am looking at things negatively because we really wanted a family but knew that if we got denied we would be apart with a child and we both did not want that.

sorry that i am not jumping for joy on my situation....i think i have actually been very honest in what i am feeling....i am going home and we will try from there, sorry if it is not what you think i should do!

ukgirl...I wish you best for whatever you've decided. It is a difficult situation and I'm totally understand your situation. I'm also the intended immigrant, who was in the states for 14 years. We've been doing this immigration process for 2 years and it's been 18 months since I've seen my husband last.

As I stated before, I think consular processing is faster (though might takes a while) than in country waiver especially for more complicated situation, such as myself who has an order of removal.

It is a tough road ahead of you, but you'll make it. It's normal to be negative, but eventually there's hope.

God Bless

i think that it is a lot faster to do it out of the country too, that is what we are probably going to do....just looking at all the hardships we have (which is not many.)

Some people look at it as being negative, I just look at it as being truthful and that offends some people!

Good luck to you, I hope you get an approval soon......my thoughts are with you!
