My fiance is albanian, the immigration officer said he needs to mail his I 212 waiver to Detroit MI because thats where the deportation happned.
i thought it was going to go to Vienna?
does anyone know how i can look up a timeline for waivers that are sent to the US?

Do you only need the 212 for deportation? Do you need the I-601 for overstay as well?

He came to the US as a kid illegal. so I dont think he overstayed anything.
The officer told us just the I 212 was all we needed.

I just looked at your other threads. It seems that because he was unlawfully present after his 18th birthday for more than a year that he also needs the I-601 waiver. He was deported, so he needs the 212 as well, but he also needs the I-601. I don't have any idea why they would sending this to Detriot. That doesn't make any sense.

What immigration officer told you this? When is/was his immigrant visa interview?

If he came to the US illegally without the proper visa and inspection at the border and then was illegally present in the US for more than 180 days after the age of 18 and was then deported...he will need to file the I-601 and the I-212 and he will have to have consular processing back in his home country. He should be eligible to file if he only had 1 illegal entry/attempted entry in to the US. Since he has been deported he will have to remain outside of the US until he has an approved waiver and is eligible to enter the US legally with a visa stamp in his passport.

The process is long and hard but it is doable. There is tons of information on this site to help you through the process or you can hire a lawyer to do it.

he had his 1st interview on Aug 30th. Then he was told that he needed to get his deportation order and bring it to the embassy and also a court record from a ticket. she said she wanted the court record to make sure he didnt spend any time in jail.
He went back yesterday the 13th and she said he only needed to file the I- 212 because his ticket was minor and involved no jail time.
Then she said the waiver was going to detrot, not vienna, and we mail it ourselves. ( not give it to the embassy)

That seems kinda weird, or is albania just different then most places?

I do not know. It makes no sense to me and no Albania is no different than any other place.

he turned 18 on april 23 2005
he got datained approx. June 27 2006
and was deported in august.

im bad at remembering dates. you think i would remember these.

So these are the facts of your case:

He EWI'd under the age of 18.

He turned 18 in the US.

He was illegally present in the US from April 23, 2005, the day he turned 18, until he was detained on June 27, 2006.

He was illegally present in the US for more than 365 days following EWI.

He was deported.

As I understand immigration he has to submit an I-601 and an I-212 and he has to do that in his country.

So I cannot help you with what the consulate told him.

I am a similar situation, though I never entered illegal or overstayed, I just never told them that we left the US after having a "temporary" green card. I was also told to file the I-212 where the deportation order resides, in my case it is in Cleveland. We filed over a month ago and we only know that they received the I-212 and cashed the check. We don't know anything more. They might process it themselves or send it to Nebraska. It seems Nebraska is really swamped with work since their dates of data entry etc. never changes.

I have never seen my deportation order, I was only told by the consulat in Sweden to send the I-212 to Cleveland.

welll me and my hbby us going through a similar case and yes he needs both waivers,,, trust me i am working on it!!!! also yes it need to be sent to the consult in his country if you guys sent it to vermont is the wrong place,,, you guys are just waisting time ,,, because they are going to sent it from there to the consulate from his country!!!!1

If the consulate in their own country says they only need the I-212 then they must know what they are talking about I would hope.

You don't always need the I-601 with the I-212.

What is frustrating right now is that we don't know if they (whoever it will be) have accepted our application. We have not received any LIN#, I wonder when we should start asking what has happened to our application.

well, i think he is gonna just send the I 212 to Detroit and hope that the embassy in Albania told us right. they told a few of our friends to do the same thing. and 2 of them are home, so :rolleyes:

We have only seen that Cleveland has received our application and cashed the check.

i have no idea.
they didnt tell me. BUT i remember seeing a post somewhere on the internet how they got a tracking number or they used the origional I 130 number and it came up as the waiver status on the Uscis website. they said something like they were just trying stuff out and put in the number like you can do with the first fiance packet.
so maybe you get a number if you are in country? i dunno.

Where do you see those processing times? I can only see I-212 processing time for the Region offices like Nebraska etc...

hummm im not sure. im not positive you can look them up. ive been on the detroit webste, and it doest even list I 212s as a paper they handle.
so, im as lost as you!

I was talking about here, someone said Detroit took 6 months for their case, Vermont posts their times because they are a Service center...I'm asking for people who've done it to reply. I need to know about New York/Buffalo...

How do you know if they send the I-212 to their regional office? My I-212 was sent almost 2 months ago to Cleveland. Maybe they respond if I send them a letter asking what has happened to my application...

heres an update on my case thats interesting...our case spent like 3 months in detroit, and then it was forwarded to Vienna, like i thought it would go origionally. i dont know why it was sent to detroit, and my friend also had the same experience with Albania.

Mine was approved in Cleveland 2 days after we contacted the senator of Ohio.

I now have the package and the stamp in my passport ready for our move to the US in April 2008.

Look for Walter's email address in the Vienna thread. He will tell you how long it will take you to get your I-212 reviewed. He's very helpful. Make sure you give him your husband's full name and Alien # when you email him.

i dont know his A# and he dosent know it. i dont think i filled it out. the papers said A# or SS number. he was illegal but he had a SS# and i put that.
could i give him the SS#?

Anyone known how to wright letter for USIC officer along with i-212
