wow, everytime I log on things are different, very nice colors here/ brightens up my mood. Anyway, here's my update. I thought my case was transferred to local office for adjudication, but received a letter stating that my case was recalendared. I called my attorney, he says "guess the judge decided to go this route". So here we go again; case was admin. closed pending stokes interview, interview passed, medical/bio done, 485 receipt received, was told by my attorney case will be handled by local office and treat as regular adjudication and was about to send orig. 485 to I think Chicago when we received the recalendar letter. Anyway, I guess I'll be following you after all cman... praise god!

Yes it's better to go through the court for the GC seeing that your case was previously there.Once the case is recalendered it could be your FINAL hearing seeing that you already had your fingerprints done and you already got the I-485 receipt but this will depend on if the fingerprints clears of course,if not the Judge will just set another date for the FINAL hearing....to god be all the praises you'll be fine! :)

I could swear the last time we talked to our lawyer, she said only the judge has the power to approve our i-485, so it looks like we don't have any other options: We're stuck with the good Judge K in Boston. Yippee.
And CaribbeanMan! Look at you! Your GC hearing is next Thursday! I'm sending good karma your way ... You must be so excited. I'm totally putting your appt in my BBerry so I remember to log on that day and see how it goes.

Yes only the Judge has the power providing that the case stays in court and it's not terminated for USCIS to adjudicate the I-485 of course :)

Hey ditto from me. I am excited for you. By the way, I was wondering, your timeline says 14 months from NOA1 to NOA2 but how long was it before your case was transferred to the local office, and how long before you got an inteview? I ask because like I said I am no longer going to look to USCIS for answers but use your timeline as a guide and make notes if it is similiar or not. Maybe there is an answer somewhere in there...

My I-130 was filed in January 07 at TSC it was then transfered to CSC a few days after.CSC then transfered it on July 24th 2007 to Tampa's local office and i got the interview on March 11th 2008.

OK...I guess that is not going to work. So it took 6 months to get transferred to a local office and than 8 months to get an interview. We are at 9 months and haven't even been transferred. I guess it is time to call customer service because we are out of the processing times posted.

Calling customer service is a waste of time...what i did was i went to congressman's office (well my wife did) and two weeks after we got the interview.

Yeah, our lawyer said it is a waste of time also. I guess I just need to feel like I have some information. But you are right. I read an interview with a previous USCIS employee over on VJ and he mentioned pulling a congressional.
My husband just doesn't get it. He is the one who is a non-citizen and he doesn't really involve himself in the process. He said to my mother I don't see why she is so worried about it, and does all that stuff on the computer, he said he knows that one day the paper they need will just show up in the mail.
When honestly, that is not how it is going to work. I am truly starting to understand why he was never successful at adjusting in any of his other attempts before he was ever put into removal proceedings. He has been here 19 years. He was just too lackadaisical about the whole process. He never educated himself about his own case and the way immigration works and he always sought out the help of scheisters in the Spanish community.
In his last attempt, with his first wife, USCIS had sent out a RFE because of her birth certificate. He claims they never received the letter, and in fact, my husband's story is that immigration lost his file, they had gone to the local office in NYC and the person couldn't find any info on his petition...so he said screw it and gave up. His mindset was that it was too much stress and that as long as he could work and earn money than whatever. Well that whatever, lackadaisical, I will do it later attitude is exactly what got us in this proverbial sinking boat. And immigration never lost a dang thing. I saw his file when we were in court and the government's attorney was reading from the previous petition.
Anyways, the point being is I need for this to be settled. I need for this part to be over. I need to feel a bit more secure that he can continue to work and do so legally, that if he had to switch or find a different job he could do so. I am tired of being the one who saves the day financially. I need for him to be legal so if he gets pulled over I don't have to worry about him getting detained, or any of the other horrible things that could happen to a person when they do not have legal status.
I need for the two year clock to remove conditions to start. I need to be able to make plans in my life that don't swirl around immigration. I want to be able to consider jobs outside of our area, and our state. I am going to finish with my classes for my bachelors in Feb. 09, and walk in May 09. I want to look at law schools that are not just located in MA. I need to be able to feel like my life is not dictated by my husbands immigration problems.
