Hi. Im citizen of Republic of Georgia. I arrived to US in 2002 with tourist visa. my dads asylum case was denied by BIA in 2004. I got arrested and deported March 2007. I have USC wife and two childs After i got deported she came here and we got married in here, she live here with me. on August 8 War started between Georgia and Russia they dropped couple bombs in the capital city 10 minutes away from our house, there is no war at this time but russian troops are still here and situation can escalate anytime. US embassy urged its citizens to leave the country, we are going to file I-601 and I-212. what do you think do we have a chance?

There is no way for us to really tell if you have a chance or not. If this is your only hardship, then I would think by itself it would not be enough to get a waiver approved.
The totality of your hardships with the documentation is what gets an approval.
My best advice to you is to do an email consult with Laurel Scott at visacentral.net It is about 150 dollars. She will be able to listen to your entire story and give you some guidance on how to proceed.
Or you could ask her for free on her chat on Wednesday at 11 am central time on her site.
She also has a memo on her site where she discusses how to get a waiver approved and what type of hardships are stronger. It would be to your advantage to go there and read her I-601 memo.
Also our lawyer Heather Poole has tons of information on her site. The link is in my signature.
There are several examples of approved hardships on this site, you should read those and see if you have any similar hardships. These approved waivers will give you an idea of the types of hardships that will get an approval.
Again it is the totality of your documented hardships stating why you cannot live in your country without your spouse and also why she cannot live in the US without you.
Also taken into account are any aggravating factors like previous immigration charges/any arrests in the US or your country.

Its not a hardship for US citizen to live in country that is in state of war? and civilian targets are being bombed??

By the time that your I-130 is processed, and the I-601/I-212 are requested, the conflict is likely to be over. Even in the past few days progress has been made (in the eyes of the govt.)
You need to look at the WHOLE picture . . .take a look at the letters posted here. Even one BIG hardship such as a state of war is not enough necessarily on it's own. You need to document ALL of the hardships your family--through the eyes of your wife--would face if you were not allowed to return to the United States.
Conflict can be part of it, but in the end you will need more.

I'm sure that you will be able to come up with good evidence and letters. Keep the conflict, just take it further.

Another Georgian with immigration difficulties like me. It is very frustrating sometimes.
I posted in this forum before,but now I am "obsessed "with the waiver questions and any answers will be appreciated:
I was approve my K-1 in April ,2008, which was denied by Con.Off and sent back for "review". We contacted the US senator, filed FIOA,etc and got one simple answer:the case was forwarded for review. I was denied under 221(G).
After that we married, my now husband came here in May and we got married.We filed new I-130,which was approved in 1 month(good sign I think)
Now I will have my interview again. I am very nervous as I don't know what will happen this time.
My question is the following: will I need any kind of wiavers ??
USCIS didn't revoke my K-1 visa and accordingly I won't have any misrepresantations in my file.
