View Full Version : tourist visa for dad-in-law while husband's aos is pending

hello all,

my husband wants his father to come on a tourist visa... his father is 65 yrs old and has been in and out of the US before on a seaman' crew visa... my husband came to the US on an h1b visa but overstayed... hubby already filed for adjustment of status based on marriage to a USc and is awaiting interview appointment... he got the ead card june 23.... do you think my husband's father would have problems obtaining a tourist visa? and would these pose a problem to my husband too? i don't want him picked up by the immigration officer in our home because his father indicated on his tourist visa application that he has a son in the US who overstyaed... has anyone tried this before? or know of someone who tried? what was the outcome?

What country is the father from? It should not really be a problem. Typically, the applicant just needs to prove that he/she has good reason to return to their home country after the visit.

Your father-in-law has to prove to the US Embassy in his home country that he has sufficient reason (family ties, assets, etc) to return if he is allowed to visit the US. Your husband's current status will not be affected by the B1/B2 application of your father-in-law. Right now your husband's status is "adjustment applicant" and he is considered to be back in status.

ditto to what everyone else already responded.

Your FIL needs to prove that he has ties back at home that would MAKE him go back even if he has a tourist visa. In other words the govt. wants to make sure that your FIL is not looking for a way to come into the US and then legalize through your hubby b/c then it would be considered fraud. He would then need to apply for a different visa if that is the case. The tourist visa is just for that...tourism. Anyhow, by providing bank financial info and if he has a house under his name this should suffice.

thanks everybody for the replies... i just didn't want anything to jeopardize my hubby's chances of adjusting... FIL by the way is from the philippines... FIL's purpose in coming here is actually medical in reason....hopefully we can get some letters from the doctors here to support his application... once again thanks guys...

The US Embassy in the Philippines is a tough place to get a B1/B2 visa. Letters from doctors will help. You will also probably need to include some financial information on your side to show your ability to pay for your FIL's medical bills.

yes it is... my mom tried to get a tourist visa 4 times and got denied each time... she had all the paperwork needed including financial information from me and also from her... but it didn't work.... they didn't even look at it...hopefully the letters from doctors will help....we'll try one time and see how it goes....
