View Full Version : Do you need permission to refile waivers after a denial?

Our waivers were denied in Rome. We dont want to appeal, we want to refile. I see alot of people have done this. My question is how do you do it? Do you need to get permission first? Do you just refile? I emailed Rome asking them about it and all they did was send the top page of the denial letter with instructions on how to appeal, nothing about how to refile like I asked them in the first place.

There are a lot of people doing this in Mexico but there are so many waivers there it's sort of a different deal. You might want to ask Laurel's opinion via consult or the Wednesday free chat.

I think outside Mexico you'll need to restart the whole process, re-file i-130 and all the paperwork all over again, but as Laura said, ask Laurel on Wed at 11AM CST @ www.visacentral.net/forum.html

I just refiled my wifes I-601 in Frankfurt. We were told by Frankfurt that we could refile and there wasn't a time line to do it. I don't know about Rome. Good Luck!!!

Appeals are against those that adjudicated before, refiles are simply postive about your situation.

Based on others' experiences, you would have a new visa interview for your EXISTING approved I-130. Probably have to re-do DS-230 provide any other expired doc or procedure, for that interview. Depending on the consulate, they should let you file the new waiver at that interview or shortly thereafter. In otherwords, you shouldn't have to file a new I-130 again.
Contact your embassy and tell them you want to have an immigrant visa interview on your I-130 and file a new waiver. See what they say.
