View Full Version : I-130 Processing Dates -- WHAT A CRYING SHAME!!!!!!!!

I can't believe this. The USCIS says they are only working on I-130 application dates for July 26. We will never get ours. We are waiting on the NOA1 so we can file the I-129. At this rate it is going to take 3 months to get our notice. I am tempted to take the chance and file it using our return receipt notice.

Those dates indicate the oldest petition they have not yet processed and do not reflect current processing times. They do it to cover their asses. Don't pay attention to it - better to check the timelines on visa journey to get a better idea.

Kitkat. Thanks. Just spoke to USCIS. They are asking people to wait 90 days. I asked if we could file the I-129f without the Receipt Notice? The gentleman said that he could not say whether or not they would accept a copy of the cancelled check or the post office receipt notice. He definitely knew that they would accept the NOA1.

However, if you look at the new instructions for the 129F, no where does it say that you HAVE to submit the NOA1 from the I-130 as evidence. It only states "must also include evidence that they have filed Form I-130, Petition for Alien Relative, on behalf of the alien spouse limited on this form, and a marriage certificate evidencing the legal marriage between the citizen and alien."

However, in the instructions under "Form I-129f Filing Locaions for K-3 Spouse" it says to mail your petition to the Service Center where the underlying I-130 petition is currently pending. "Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129f."

I am assuming this is saying to include a copy because a lot of the applications are transferred and this would make sense to include a copy.

When I called him, he did not sound at all concerned if I were to send some evidence other than the receipt notice. Is it worth the chance? What's the worst thing that could happen? They reject it and send it back -- right????

Djones - I think they most they will do is send it back to you as a rejection. I would do it with all the evidence you have of proof that you sent in the I-130. If they send it back it really won't be a waist of time since you are still waiting.

Yes I wrote back it must have gone through. My internet at home is not working right now so I tried to reply through my sidekick. I don't mind giving you my input. I mean I have not personally had an accepted one, but I have had good feedback on my draft when I posted it. Send it to me and I will check it out.

hey, i'd go for it. i'm not doing the i-129f, but you don't have a lot to lose at this point.

i know i'm being really whiny about this, but i know you (and a lot of others) share my pain so i hope you don't mind...so we're supposed to wait 90 DAYS FOR A NOA1 and some people are getting APPROVED in 60 days, and others got an NOA1 in a week or so???????????????????

i don't think there's a smiley for my emotions right now (and do we call them frownies when we're not happy?) but i'll try: :curse::angry::bang:
