I keep getting different answers to this question is it one year or 45 or 30 day?for the i601 some say that the only to get a year is to get it extend? i need to know if it 30 days i need to work fast.

My fiancée was dined the K1 visa in manila.The question is How long after the K1 visa was denied do i have to file the I601 waiver I have heard 1 year And i have heard 30 day which is it?

From what I have always heard it is 30 days.

Is that right? where im i geting that one year thing from what should i do i only have like 3 weeks to get this latter done and mailed.

It is one year. They give you one year to apply for the 601 waiver. It should say it in the waiver forms or denial form they gave you.
Edit:
There is no way on earth anyone can prepare a 601 waiver packet in 30 days. Rest assure it is one year.

ya the denile paper didnt have anything on it just a chack mark on why she was denied but the part about the waiver was left blank.

One year from denial. See my signature line - mine was filed just in time.
Edit:
The 30 days you heard about may be referring to appeal of denial of the I-601 waiver. I think that you have 30 days tp file appeal.

My fiance's denial notice (of K1) also did not have the box checked for eligibility to file the waiver. Nevertheless he was handed the application and told he could file it the next day if he wanted to... I guess CO did not knpw how much work goes into a waiver. As posted above, no way to prepare a waiver in 30 days. I had to prepare further evidence to supplement the waiver in 30 days and that was hard enough.

I think you have to be careful, the 129F has an expiration, the I-130 doesn't. The 129F may have already expired, you will need to contact the consulate to find out if it is too late to do an extension.

So in your case did the K1 expire or did you need to call to get it extened?

K-1 did not expire.. He did not receive the K-1 in any case, he was denied. But not denied at first interview, as he had to bring in court papers. K-1 interview was Oct 2006. He brought court papers to the embassy in
feb 2007, then was denied. So he had 1 year from 2/07 to file the waiver.
Now if you mean I129F was submitted, but you didn't have the interview for the K visa yet, it might be a different matter. The I129F can expire if you send that to the embassy but don't schedule and go to an interview. Ask your consulate about that.

Laurel: The consular case is kept at the consulate for one year following the last action on the case. If the visa applicant requests that it be kept at the consulate more than a year, you only need to ask and sometimes supply a reason. You can file the waiver at the consulate as long as the case is located there.

yas Laura answared that thanks, there was a sub qustion about the k1visa expireing meaning that the waiver you can use a year but the visa?
