I am asking this question for a friend. She will be 19 in November and she was wondering if there someone that may know if she can adjust her status. She had been in this country since she was five. Her parents brought her here illegally. Both her parents have not been able to adjust there status. But she has an older brother that is a legal permanant resident for 3 years now and soon will try to become a U.S Citizen. Does anyone know if her brother would be able to file for her? If so about how long would it take? or should she wait on the election. One more question would her brother be able to summit the application and if there is an immigration reform would she able to benefit from the law changing or would she be locked in to the previous application. Any responses are greatly appreciated. Thanks! :anyone:

mary,
unfortunatly not for now, maybe there is a reform in the future. If he files for her as a USC, it can take between 12 to 15 if the aren't Mexicans and 16 to 18 if they are. The problem is that with the current laws, she isn't elegible to adjust in the US, siblings of USC have their appointments in their countries, and if she leaves she will trigger the 10 year ban, there is no waiver for siblings.
