Ok - so after a bit of reading on the VJ site, I have realized that our NOA1 actually has 2 dates on it. In the past, I just looked at the NOA1 date, assuming that was the one they process it by. It has the date it was actually received (May 25) and the NOA1 date (June 8).

It seems the several members on that site believe that they will be processed by the 'received date' and not the notice date, as the notice date was simply when the printed up the form to mail. But yet, they firgure out all of their timelines, estimates based on the NOA1 date.

Just out of curiosity - for processing purposes (and my timeline :shy:) - what date is the actual one that USCIS goes by?? In my case, would it be May 25 or June 8? I have always went by the later date - but wonder now if that is correct or not. (I hope it never becomes an issue and we are outside of their processing times, but if we ever are, I am wondering what date would be correct for my case) I have asked this question on that site without an answer so far, so I thought I would try to get an opinion on here!!!

:include: lucky I'm not sure what we went by...I think it was the received date...but I can't remember...lol I can't remember much before yesterday...

argggggghhhh! i HOPE they go by the received date! let me know when you find out, because they received mine on the 19th of august according to the USPS return receipt, and we're going on a month now and STILL no NOA1!!!! so the received date would put us significantly ahead of whatever date they send out the d$%# NOA.

I can't believe this. The USCIS says they are only working on I-130 application dates for July 26. We will never get ours. We are waiting on the NOA1 so we can file the I-129. At this rate it is going to take 3 months to get our notice. I am tempted to take the chance and file it using our return receipt notice.

djones, how did you find out that they're working on july 26? i guess that's what we get for filing right after the fee increase because so many people were filing at the end of july to try to beat it...i couldn't because i got married 4 days after the increase! i was ticked when we found out, but we already had everything set for the wedding and it seemed so anticlimactic and unromantic to rush to the courthouse to get married earlier just to beat the deadline...if i had known, though, i might have done it.

djones - I am curious to see where you got that they were working on cases from July 26.

According to the USCIS website, CSC is working on petitions dated Feb 12, 2007 and VSC is working on I-130-s from January 31st.

Did you mean that they are issuing NOA1's now for cases sent in on July 26th?

I guess maybe I am just confused because I was looking for information more on what date our case will actually be processed by and you say they are working on cases from July 26th ?!?

Thank you Klame! Glad to know I am a May filer, right behind you actually!!! It only makes sense to me that they do it that way considering the delay in getting the actual NOA1's issued. Ours took 17 days - and now I can be sure that it is not 17 days 'wasted'!!

Sorry -- didn't mean to confuse everyone but I see how you were. No, I was actually referring to the Receipt Notice dates. They were just put on the uscis.gov website today. They are working on I-130 from Vermont received July 26 -- nothing to do with processing dates. We are waiting for our Receipt Notice in order to file the I-129.

USCIS Application and Receipting Update

U.S. Citizenship and Immigration Services (USCIS) advises customers that, due to a tremendous increase in the number of applications filed, processing of fee payments and entry of cases into our tracking system is behind schedule. As a result, applicants can expect notices of receipt to be delayed. USCIS is working hard to deal with the increased volume.

Delay in fee processing and data entry will not affect an applicant's Change of Status or Extension of Stay eligibility if all other eligibility requiements are met. USCIS continues to process Premium Processing Service requests within 15 days.

USCIS will honor the actual date that an application was received in our mailroom; this date will be indicated on the receipt (in the Received Date box) when Form I-797, Notice of Action, is mailed. Until this situation is resolved, USCIS will provide these weekly updates on progress in issuing receipt notices to our customers. We appreciate your understanding.

As of September 7, 2007, USCIS has completed data entry and issued receipt notices for applications and petitions received on or before the dates indicated:

Thank you angela. I found that page as well and posted it in a different thread in regards to jsierra's comments.

No worries djones!! We got it all worked out!! :thumbup: I was just confused because I was talking about different dates in regards to when petitions got processed - and you said gave a date without really explaining what it was for. I assumed at first it was for processing the petitions....'til I researched it a little more on my own. I hope you hear something soon for sure!! They have to speed up at some point again, right?!

Well, considering that they only moved 1 day in 1 week (last update was 8/31 and the receipt date was 7/25), I have high hopes that we will receive our notice by December!
I guess I should say "it's my turn to wait." However, I just want to get started because I am afraid with all of this waiting time that my SIL will lose his job and if that happens, it would be a good time to just return home since he has to anyway. His company was just bought out and they made all employees fill out new employment applications. Wonder what that is about? He plans on quitting his job when he has to return home but we were hoping that he wouldn't have to do it until he was ready to return. However, there is now a chance that he could lose his job before he has to return home.

hey djones i just had a positive thought (though i have no idea if it's true or not). ok, so if everyone was filing to beat the fee increase at the end of july and they're now on july 26th, doesn't it kind of make sense that processing will be slow through august 1 and then return to its normal pace, since people probably filed at a normal or even slower rate after the fee increase? so we just have to wait it out till they get through with july and then maybe it'll speed up again.

am i making sense?

Yeah it makes a lot of sense. However, my scenario is that: If it is taking a week to process 1 day's worth of applications, then I have another 5 weeks to go until they hit August 1.

i know how much it sucks and i feel your pain...just trying to cheer you up :flowers:
better 5 weeks than however many weeks it would be to go day by day from july 26 all the way to the day you filed!

Thanks for the positive thoughts. I hope you are right. However, dealing with USCIS, I am trying to think positive but am afraid that it is going to take one day at a time. Hey, it's like that tv show -- One Day At A Time. I guess I should be lucky and feel lucky because there are a lot of people out there in worse situations than we are. What is wrong with me???????????????? I am going to start thinking positive. Thanks.

anyone know the phone # you can call about your case? i'm hoping i can possibly get a case number if my case was received even without a NOA so that i can check on it online.

Calling them won't help because they will only tell you to wait 90 days. They haven't even gotten to process ours yet. However, you can call the general number and start punching.

What is the NOA1 and NOA2?
The terms NOA1 and NOA2 are internet language for the following:

NOA1 = Notice of Receipt of your petition.
NOA2 = Notice of Approval of your petition.

You may receive other Notices Of Action prior to receiving your approval notice.

General info on the Notices of Action

NOA's use either form I-797 or I-797C. One is just an earlier version. One will use Received Date, the other Receipt Date, but they have the same meaning.

Hopefull the below will help you to understand the dates on the NOA's. If you were to put your NOA1 & NOA2 side by side this is how it would read.

Example:

NOA1.............................................. NOA2
Received Date: October 13, 2005......... Receipt Date: October 17, 2005
Notice Date: October 17, 2005............ Notice Date: November 22, 2005
Priorty Date: 'will be blank'.................. Priorty Date: October 13, 2005


Highlighted in RED is the NOA1 Received Date & NOA2 Priorty Date. This is the Date by which USCIS uses and also the date that we use to guage whether our date is past the processing date.

If you look at them both together, using how they are highlighted, there is a pattern.

If you note you will see that all the receipt date (NOA2) is, is the date that the NOA1 (Notice Date) was generated.

ok, how long do you wait to gauge whether your date is passed the processing date? i know via usps that our receipt date was 8/19, but since i'm supposed to wait 90 days instead of the 4 days illustrated above for the NOA1 due to the backlog (grrr) i don't have official uscis notice of that receipt date. so how many days till we're past 8/19 are we passed the processing date?

Anyone who files an I130 for their spouse has the option of also filing I129F - or the I129F can be filed by itself if you are not married to you fiance yet.
