does the pilot program only applies to the 601 waiver???

does the pilot program aplly to the 212 waiver,,??

very confuse can someone please explain,,

and how can i apply through the pilot program

Husband was deported I know i need a 212 waiver:innocent:

Read the link in my signature - the pilot program is for ANY waivers but it does appear that people with both 601s and 212s are generally being sent to the backlog rather than being approved on the spot.

You need to set up an Infopass appointment for a date shortly after the CDJ interview -- that's when you submit the waiver into the pilot program.

you seem to know alot about these cases and yes i just confirmed withlawyer hubby needs both waivers so we are probably going to be sent to the backlog,,, so you say that when we get interview to cdj then 2 days after i can turn in waivers through the infopass???


also can you explain about the enactment of 1997

what happens to people who eneter before and after 1997???:innocent:

Any unlawful presence prior to 1997 is not counted, as is any unlawful presence prior to the age of 18. If your husband had an aggreagate of more than 1 year of unlawful presence after 1997 and departed the US and then subsequently returned unlawfully to the US, he will be facing a lifetime ban with eligibility to file a waiver after 10 years. If your husband entered the US and never left before being deported, he will be facing a 10 year ban from the day of his deportation with eligiblity to file a waiver after he is denied the visa at the US consulate abroad.

US consulate,,, if he is already in Mexico ,,, then why would the US consulate deny his visa???

Anita- your husband is ineligible for a waiver because he entered the US illegally and stayed longer than 180 days. The US consulate in Mexico will process his visa application- they will deny it- you will file a waiver asking that the 10 year ban for his illegal presence be waived- and hopefully it will be approved.
