hello all
our i130 was approved june 2007 and our 129f was approved january 2008
after the 130 was approved last summer i contacted lawyers and was told that the time wasnt right to file the waivers for us(maiinly because my husband has criminal convictions ranging from age 15 until 21 and he is now 24 years old) well we are now deciding to file because we really cant take it anymore, i went to live in macedonia from october 07 until july 08 and we have a 14 month old and i came back to the US with my son 2 weeks ago because we cant make a living over there and my husband is unemployed there and i am pregnant now and the medical care there is not safe for me to monitor my pregnancy and definitely not having a baby there.......i dont want to wait around anymore to file and feel like we shoul d try since we have the opportunity to and i feel as though i have extreme hardships.

is the i130 expired by now? do i have to file for a new i130 because i know the old one is at the nvc and also the 129f is at the nvc and was never sent to the country my husband is in which is Macedonia..i am guessing they never sent it cuz the 130 was approved? well does anyone know if can i do anything about getting the 129f forwarded to macedonia? I really dont feel like starting these petitions all over again and paying all over again too. thanks for any help an d good luck to you all

I think you can contact the NVC and they will forward the case. it's wierd that they didnt already do so. My husband and I filed for the I130 and I129F. When they were approved, we got a letter saying that everything was taken care of, and if we wished to pursue our case it would be in Tirana where they mailed it. They also attached a list of documents we would need to bring to the interview in Albania etc. Everything was straight-forward and explained. You should find out why they stopped processing your case. Just make sure your hardship is really extreme. It is hard to overcome deportation AND criminal convictions.

How long has it been since the I-130 was approved?

If it has been less than one year since your last correspondence with the NVC then you can just contact them with an address change and go ahead and pick up the process where you left off. They can start sending you the support docs and DS-230 so that you can get an interview. You will probably need the NVC case number to get anywhere quick.
