A dear friend of mine and her 1 yr old son were brought here EWI by her American husband from Mexico.

They met while he was down there studying. When they realized that her ex would not allow the son permission to leave to the US they went EWI.

Upon their arrival to the US he decided he missed his old life and subsequently abandoned her and her son and returned to his life of drugs and violence. His mother felt bad and cared for her and her son for a few years.

Long story short- he would come and go and at this point they have two children together. He became very abusive (well documented by police) and they have since seperated. She now has has one EWI son and two citizen children.

She hired an attorney and was since granted a work permit due to the documented spousal abuse and expected visa granted due to the domestic violence. She has been separated from hubby for 4 years.

She recently had her "final" appt in Memphis but her "lawyer" did not advise her that she should bring tax records etc ...Appears the case was denied. She does still have the work permit. After many many years of volunteer work translating she NEVER filed taxes.

K, there's more...

She has been living with her boyfriend for over 3 years and they have been holding out on marrying because of the immigration case. She wants to know if she should go on and get married and adjust the type of visa or continue fighting for the U visa. Her lawyer is non responsive on the route they should take from here...


oops.. this may be a VAWA that her attorney was shooting for.....
