View Full Version : Interview Done - Waiting for answer for 3 months

Hubby and I got married Dec. 2006. Everything seemed to be moving pretty fast and we had our interview on June 8, 2007. The Chinese lady that interviewed us was VERY picky. We were separated, and literally grilled for almost an hour. This is my 2nd marriage. My ex-husband had also filed for me but after about a year of marriage, I filed for divorce, and AFTER the divorce was final, ex-hubby withdrew his petition. I divorced him b/c I found out he had quite a few arrest warrants out on him for petty crimes and other things were going wrong too in the marriage.

Fast forward, during the interview, the lady didn't ask as a single question about our marriage. Her primary and only focus was my ex-husband and my former marriage. Asked me and hubby (while we were separated) if my current hubby met my ex, what did they talk about etc. etc. etc. Apparantly while talking to my hubby, she made a comment that something seems "fishy"!!

We did have a lawyer who was with us at the interview and even he couldn't believe what went on. After the interview, we were told she'd review the case and let us know her decision. That was almost 3 months ago.

Is it "normal" for them to take this long to make a decision? My current EAD is valid until next summer so working isn't an issue but I want to take hubby back home so he can meet my extended family. :(

One more question, when I get the GC that's conditional, the 2 year count, does that start on June 8 (the date of the interview) OR does it start when they approve the GC?

It sounds like you had a Stokes Interview which is what they do when they don't believe the validity of the marriage.

Hasn't the lawyer attempted to contact them to get a status on your case? That would be the first logical step.

Well the lawyer said to wait and see.....he said it could be that maybe they're still waiting for fingerprints to come back. I haven't spoken w/ my lawyer in almost 2 months and am thinking about contacting him again. But thought I'd see if this was "normal".

I guess I was surprised that she wasn't at all interested in my current marriage.

Do you by any chance know when the 2 year date starts?

Conditional date starts upon receipt of the green card.
