Hello, am waiting for appt. letter for CJ...my approved I-129 is good only until December of 2007. What if I don't get an appt. before then, do I have to reapply for the I-129 all over again, has anyone else experienced this?

Is it for a K1? When did the NVC send the case to CDJ? Generally it takes CDJ about a month to send out the fiance packet for a K1 with the open appointment letter. If it's their delay, you can request that they extend the approved petition.

The Consulate can re-validate it for another 4 months. Please refer to State Department website for questions regarding I-129.

Thanks, its for a K-3, I'm just scared that it will expire before we get our appt. to CDJ..NVC sent it to CDJ the last week of Aug. 07

My K3 was sent to CDJ that same week (or shortly after), and I was also wondering what to do if we didn't get the appointment before our I-129F approval letter expired..........but it sounds like we should be expecting the packet soon.

Do they send the packet to the beneficiary in Mexico? Someone on here told me no but I was sure I read that it's sent to the beneficiary.........that worries me a little considering how unreliable our mail is here. Any thoughts?

Hey guys, so my I129 will be expired by the time I go to my K-3 appointment. It expires in Dec 07 & my appointment is Jan 08. I called the 900 number in Juarez and Ms. Cordoba said that there would be no problem if my I found the following I 129f is expired. I then called the NVC because I didn't believe her, they said the same thing. So then I made an infopass appointment to ask the immigration officer and she had no clue what so ever. So how and where do I revalidate it? Do I do it in Juarez and do I need to do it before my interview, and how long does it take to be revalidated? Has this happened to anyone? I'm scared that we go to CDJ & get denied because it will be expired...please help..i'm so stressed and we have our stuff all ready to go....do you guys think it wont be a problem as the others have said?

Extending the Petition
The I-129F petition is valid for four months from the date of approval. A consular officer can extend the validity of the petition (revalidate the petition) if it expires before you finish processing the visa.

There should not be any problem because it's their delay due to appointment scheduling. They can revalidate there in CDJ - it has to be a CO who does it - although I doubt they will even feel that it's necessary since you are going to your interview.

I wouldn't expect the NVC or infopass to know anything about that since it happens at the consular end. Why not email CDJ to get confirmation that there won't be a problem? That would be the most direct way to address it.

Hey Kitkat, thanks, i actually called the 900 # & she said that it was not a problem at all that it was expired..I dont know if I should belive her, I'm scared to go and then have them say, sorry its expired..

Sol, I'm really glad you're checking into this, because my I-129F approval expires on Dec. 7 and we still don't even have an interview date........I've been worried about this too.

Most consulates routinely extend the validity of an approved I 129f simply by continuing to process and schedule an interview. I'm sure that's probably still the case, especially now when service center wait times have been so long.

If the I 129f has indeed expired by the time your interview rolls around, I would have both the USC and non USC write new letters of intent. If they were going to get picky about it, the letters of intent would be their way to confirm that the initial reason for filing the I 129f (your desire to marry) still exists. Aside from the fact that the non USC arriving for an interview also validates their intention to still marry the USC - and the USC's affidavit of support should also clearly spell out the USC's intent.

I wouldn't worry about it a moment longer.

I wouldn't rely on anything the call center says although it's true that it should not present any problems.

I would email the consulate directly. They are the ones dealing with your approved petition and interview. Ask them to confirm in writing.

When mine was about to expire, I sent and received the following - it's really quite simple:

My email:

To: CDJ, IV
Subject: Extension of I-129F petition validity Case Number XXX:
The Notice of Action for the above referenced case number indicates it is valid from September 6, 2006 to January 5, 2007. The beneficiary interviewed in Ciudad Juarez and submitted a 601 waiver. The I-129F petition will expire during the 601 waiver processing time.

Question: Will the consulate automatically extend the valid dates of the I-129F?
Question: As the petitioner, is there anything I need to do to ensure 100% that the petition validity dates are extended?

That expiration date is related to begin the process here at the Consulate. Mr. XX already started, so his K1 visa process and/or waiver process won't be affected because of that expiration date.

When we went to our appt in Jan. 2007 the K-3 was expired and we had no problems.

jlgherrera, I would be concerned and try to follow up because if yours expires the 7th of december, this means you were approved a day BEFORE us. Mine expires on the 8th of December...

Sol, I have called four times, and the last guy yelled at me because I'd already talked to him before, and he keeps telling me I have to wait five to eight months. I don't really know what else to do, but it seems like we are way outside the normal time frame.

Ok, then send a fax, send a letter and keep trying to call on the phone to speak to someone different. Create a paper trail documenting your inquiry. Follow kitkat's advise. Wishing you good luck in getting the answer you need

Ok, I went ahead and emailed them as a start. I just feel hesitant about pushing them on an interview date when, according to what they're telling me, I'm still well within a normal time frame. Of course, from talking to Sol and others, this doesn't seem to be true............I just don't know. I don't want to be unnecessarily demanding if they really are swamped with applications, but I also don't want to miss our appointment because I wasn't demanding enough!

ok ..JLG, the receipt date of my I 129 is 3-26-07, and your time line says march 8th 07? so you are ahead there...My approval notice is 8/9/07 - 12/8/07 ...so you're still ahead there, I don't understand? Maybe it took longer to process at NVC..have you called NVC? I am wondering if you being in Mexico makes any difference?

I guess you wouldn't need to call NVC, do you think they are that behind, does anyone else have an appt. around my time or soon after? Maybe we can investigate, thats wierd I haven't heard of anyone else going during the time I am..

Thanks for checking, Sol. The only other thing I know for sure is that my petition was received at CDJ on September 19. If yours got there sooner, that could make the difference.

I called today...........the guy was really nice this time and told me he was pretty sure it should be scheduled in the next month. Who knows though.

I just was on visajourney looking to see if anyone had an k3 interview in Juarez and I noticed...one woman was approved on Oct.3,07 and she has her interview Dec.20,07. Thought you'll would like to know.

it says the I-129F NOA2 was Oct.3. That's what I don't understand..yours was there long before. Where is your interview.

I sent an email the other day asking for information on why our appointment has not yet been scheduled.........any idea how long it generally takes the consulate to respond? I'm trying to be patient but I am just really getting worried........seeing people this far behind us getting scheduled is so frustrating.

The Consulate's email is down. Laurel had stated that at her last chat. she said that the best way to get in touch at this time is fax or mail. I am sure everything will be ok. I only noticed one person scheduled before you. Who else have you noticed scheduled before you?

Sol1975, although her timeline is super close to mine. Thanks for letting me know the email is down..........I will try a fax. And actually, just hearing someone say that everything will be ok is somehow comforting. I know that it will be, but sometimes I need to be reminded. Thanks. :)

Yes, the last guy said that there was no interview scheduled yet, but that at most, it should be scheduled three months from the time it was received, which would be December 19.

So, after many many months of waiting for an interview, and not seeing my family, my parents and brother have bought plane tickets to come visit me and my husband in March. This means my interview should get scheduled that same week, right? :bounce:
