I graduated from college this past June and I applied for my OPT back in April. I was told that there was a 90 days processing times for the application and so I was told to expect my EAD card sometime in the end July. My question is, what happen if after 90 days I still don't get my EAD card? I know that for F1 students there are 60 days grace period until they have to leave the US if they don't apply for OPT or otherwise they will be overstaying their visa. But how does it work for those who already applied but still haven't received it?So the 60 days after the end of my program is in about 3 weeks. If I still don't have my EAD by that time, can I still stay in the States legally? My visa is still valid until 2009 and I also have an I20 issued by my school.

If you don't get your EAD card within 90 days, you can schedule an InfoPass appointment at your local USCIS office and request one to be issued then. EADs are, by law, to be issued within 90 days.

If you applied OPT under "Post Completion" then you have only 90 days to find a job.

Students can't spend more than 90 days as unemployed once OPT kicks in.
