Ok guys sorry it took so long to get back to you all I flew in late this morning the case was rescheduled for August 28th because the DHS ATTORNEY DID NOT HAVE MY FILE!!!!!,yes can you all beleive that??!!!:angry:.She said it was at the National Records Center and she requested it but it never came in time for the hearing but it would definitely be there for the next hearing (she said she'll see to it),the Judge was furious with her he said "don't you realize that he is coming from FL??!! when can you have the file here??!!".The Judge was ready to finish the case he was even joking around with me asking me about some pictures that we had presented.He told my lawyer he wanted to go ahead and do everything so that the file will be the only thing that has to be view when we come back.As a result of the file not being there there was no way of knowing if the fingerprints was cleared for sure but my lawyer and the Judge said that from their experiences with these cases that it is cleared given the time I took the prints.That district office is the most disorganised office,alot of lawyers were complaining about their service.So that's it guys i go back on August 28th AGAIN!!

Hi Auntlily it's not my attorney it's the Govenment's attorney.They have what is called the "A" file which have all your immigration information and the results of the fingerprints.My attorney had everything required.

It is frustrating to get 99.99% of the way there and hit a roadblock.

If it's of any solace, I've encountered this frustrating issue several times, so it's all part of the journey. The Stokes was your do or die moment and you made it through.

Hi Daniel,thanks!...Is it true that there is no way of knowing if the fingerprints are cleared until the actual day of the hearing?..If the file is at NRC how would they know if the prints are cleared by just getting that file.

You can have your lawyer call the trial attorney a month before the hearing, a couple of weeks before the hearing, a week before the hearing, how ever many times without pissing of the trial attorney. That way you will know if the prints are clear ahead of time.

In my opinion, its best not to ask for adjournments if the prints aren't clear because they can clear a day or two before the hearing (that happened to a client of mine last winter). If you are at the NYC EOIR, (You are, no?) the trial attorney may very well not have your file until the day before the hearing. So all your lawyer's attempts may not help things. At some point your prints will clear, and if there are no negative equities in your adjustment case, you will become an lpr.

I haven't handled removal proceedings there. I would assume that as you are dealing with an immigration court near a border area, the docket is full and delays can be more of the rule than the exception.

Ok guys sorry for the wait i just got in but the file did arrive but the fingerprints were not completed yet,the Judge could not believe what was happening and he asked the DHS attorney when he think the fingerprints would be completed and he said in about two weeks(yeah right!) the Judge said to the DHS attorney "This guy wants to get on with his life" so he told my lawyer told keep in contact with the DHS attorney and as soon as he gets word that the fingerprints are cleared the Judge instructed my lawyer to call the clerk of the court and let them know and the Judge will then schedule a date WITHIN A WEEK from my lawyer's call and have the case over with.As for now my presence is waived at all hearings until the fingerprints are cleared.Yes another set back it's just unbelievable!

Just be patience amigo, I know that you want to move with your life and you are doing everything by the book. The end is coming I know is frustrating but the best is yet to come.

Same thing was for me it took 11 months for my file to be transfer from the court to the local office and I did 4 infopass .

Update: My lawyer emailed me yesterday saying that he's gonna go to the District Office sometime this week and next week and to give him a call by Tuesday as he should have some answers regarding the status of my fingerprints.

I checked the immigration court information line and apparently my name check cleared because it use to say next "master calendar" hearing now it says "indvidual" hearing.The Judge told us he would not set the indvidual hearing unless everything cleared and it's set just two weeks from the last hearing which was November 11th(yesterday)...I'm waiting on my lawyer's email.
