View Full Version : whay we can not refile in some consulates?

Our lawyer is preppering a new huredship letter to refile it but a menber on this thread tolled me that the Ghana consulate will not lett me to refile it is that possible? My deniel dessision was in jun17th so i past the 33days and i can not appeal do you know what can i do ?

I know that you can refile in CDJ, in Vienna, in Lima, in London, etc. I don't know why Ghana would be different.

The I-130 is still valid. You have to contact the embassy and ask for an interview to apply for a visa based on an approved I-130. You will have to go through the entire process again just like the first time. You will be eligible to file the waiver and then you file it. It gets adjudicated again just like the first time.

But the key to this waiver getting approved is to make your waiver package the strongest it can be. You can address the reasons that DHS put for your denial in your new waiver packer.

Please be sure that with this waiver filing, you don't give them any opportunity to deny you. You must prove why you cannot live in your country without your spouse and also why you cannot live in your spouses country with him and you must prove this with documentation. Good Luck!

i am having the same problem with guyana.. the consulate is making us start all over again with a new I130

hi.. we just started the process all over again... we haven't gotten to that stage yet.. i don't think you would have anything to worry about if they approved your first one...
