Hello everyone,

Please help,

Oct-2004 filed I-130 and petition was aproved,
received interview date on 08/01/2006, Visa was denied.

I Christina( US citizen) filed petition for my husband Fermin (Mexican citizen)
we have two children both US citizen.

My husband was denied under section 212(a)(2)(c), we went to an immigration attorney, first he told us the my husband would never enter the US, then on a later date he asked for 3000.00 dlls to start his case and said my husband only had a 20% chance to enter the US under a tourist visa.

a little info my husband was caught in 1997 crossing a car with 86.8 lbs of marihuana, was deported after 38 days in county jail and has NEVER attempted to re-enter.

WE have been legally maried for 5 years, but have been a couple since 1994.

any help is greatly appreciated.

:scratch: I'm not sure, but I think he will never be issued a visa, the only waiver available is for children of traffickers. :scratch: So sorry to bear these news :shy:

I'm afraid that if he has a conviction for narcotics smuggling, he will never be eligible for a visa or a waiver as he considered a drug trafficker. I'm sorry.

I'm very sorry, but that is definitely, absolutely, a lifetime bar with no waiver available ever. You should consider living in Mexico or living on the border where you can commute into the U.S. Your husband will never be legally allowed to enter the U.S.
