I will be filing our 601 in El Salvador. I have been searching trying to find some example approved HSL's in El Salvador.
Where can i find them?
Or Does any one have some approved letters that they can post?
I am very curious to see the types of hardship letters that get approved.

I did see one in the Guatemala forum, hopefully this will help direct you.
I think there are more inside some of those threads.
In your I-601 you must bring attention to any and all hardships the U.S. citizen will incur, not the beneficiary.
You must document all your hardships to the best of your ability.

I don't believe there are any approved letters through El Salvador on this site. I know Paige is/was going through El Salvador and there are a few newer people around but no one has posted a letter yet for the site. That said, generally speaking, Mexico, Guatemala, Honduras have pretty much the same standards, so looking at those letters should help.
I made a sticky thread at the top of each forum with approved letters that correspond with those areas but right now there are just a couple from Jamaica, Barbados, etc.
Eramirez you have a really good letter, so I don't think you need to be too concerned. Just keep doing what you are doing and sharpening it up. Hopefully you can be the first person to put up an El Salvador approved letter!

eramirez1, There are no El Salvador waiver letters on this site. Before the site changed hosts there were 3 people who filed from El Salvador in 2006 and they were all approved. I know I saw the hardship letter for one of them (I think he e-mailed it to me), but other than that, we are blazing new trails here for El Salvador. Hopefully reyluna and I should be finding out very soon if we are approved. DHS received our waivers within a week of each other.

Hello everyone I am new here.. I have found alot of your post to be very helpful. We just sent off our final set of paper work 3 weeks ago. So know we are waiting on ericks interview in El salvador. I am starting to write my Wavier. I was wondering if anyone had any examples...

This is such wonderful news.
I'm hoping that next year i'll be able to post an approved letter. I'm excited to see that it only took 6 - 7 months to get an approval for Paige and Reyluna. I can't wait to see the approved letters, so i can see just how much hardship it takes to get approved.
I'm concerned that i have too much hardship but i guess too much is not a bad thing, i just dont want to be overwhelming.

I have just found this website after years now in the process. I'm married for four years now to a man from El Salvador, and we have a three year old son. My husband finally bought his ticket to leave. We have long since been prepared for the interview, but procrastinating. He's leaving mid August, but part of me wants to put it off again. The possibility of a backlog, a denial, is it really worth it? We had a call a few days ago from a friend who watches Don Francisco. He's had some lawyer on his show suggesting that now is not the time to go. Next year will be the year for a change in the law, according to him. I can't find anything that even remotely suggests that Congress is prepared to take it up again, except for comments from last year saying nothing will happen until at least 2009.
Has anyone heard anything like this?
My husband needs a waiver and he has criminal issues from 20 years ago. To go or not to go?

Welcome mmegan2!! Does your husband have his interview date yet? I would definitely say don't go until the interview comes date is close. You don't want to be separated longer than necessary.
What kind of criminal issues does your husband have and did he only EWI one time? My husband had a couple of misdemeanors, (nothing involving drugs or guns), from 7 or 8 years ago and just got approved.
If there are no serious complicating issues, I would definitely say proceed with the process. Just imagine how you will feel when you are back together again and you have your whole rest of your lives to live together freely without having to be looking over your shoulders all the time.

Paige used a lawyer? I'm trying to see from those that have been recently approved through El Salvador - did you use a lawyer for your waiver packet?

from what i have heard, using a lawyer is good but dosent help getting approved any sooner... i meet this girl on another forum and she got approved in 5 months with no lawyer so i think it all depends on how much hardshp you have on your letter

I'm not as concerned about the time (as long as it's under a year) but I feel that my hardships aren't extreme enough - maybe a lawyer could make them seem worse for this purpose. I guess what I would want to see is what ES is considering extreme. But we wont know until we see an HSL, hopefully when these get processed we'll have some on the forum.

if you dont mind me asking, what kind of hardship are you listing on your hsl? you cant really claim extreme hardship if you are going to be living with him all that time...i mean you can say you cant live out there all that time because of etc...etc... but you cant say you are going to be going through hardship with him being away when you are going to be with him they are just going to see that you can live there since you are going to do the whole transition. i hope i didnt sound confusing... but thats just what i have heard because i wanted to live with him out there too

I have no health problems and no financial ties here nor any kids. I dont have a mortgage to pay, the only thing are student loans and my payments are fairly low under $100 a month (considering thats a whole months pay in ES) but most ppl would say thats not an extreme hardship.
Mostly I'm arguing that I cant live there permanently because I have nothing to there and everything here. 1. Further education, working on becoming a CPA 2. Lose company tuition reimbursement program 3. Insurance 4. Holding off having kids until return because we want to have insurance 5. Healthcare in ES 5. Crime 6. Career cannot transfer (ES usus different accounting rules, i would have to relearn - degree is useless) 7. Strong family ties - I'm sacrifing a year away from my family but it cannot be a permanent situation - aging parents
None of these are major - even according to the argument list these are level 3,4,5 arguments. I'm hoping to see if this could be upped and made stronger by a lawyer or maybe I can do it on my own.

ok that sounds good...i have some that are the same but right now my biggest hardship is my pregnancy...i am hoping that, that will be the best and biggest...i havent heard of pregnnacy being one but ill see what happens

I know you all want to see my hardship letter, but I am sorry, I just don't feel comfortable posting it. I will say that I did not have any extreme hardships either, and my husband even had a criminal record, so unless they change their standards of hardship, I think you all will be fine with the hardships you have. Tropical, I can't say how they will look at your living with your husband down there.

I totally understand where Paige is coming from in regards to posting her letter online. Let's respect her privacy and refer to the examples of the approved hardship letters that are already posted. :wink: Most importantly, my lawyer said to NOT refer to anyone else's hardship letter as a guide, but to simply write my hardships in my own words as if I were writing a letter to a good friend, but to be a little more formal. Just wanted to add my two cents worth! I'm sure all of you will do great with you hardship letters! I know this is such a nerve-wrecking process, but we are in it together to support one another! :cheerful:

This in itself helps, thank you very much. Totally understandable if you do not feel comfortable posting your letter, it is a personal decision.

paige, thanks!! yes this is our 1st child together and a big surprise because we werent trying well atleast not right now because he will have to leave pretty soon!! we are hoping my pregnancy helps out alot but i highly doubt it.

Thanks to all who are posting on spouse's from ES it is so hard to find info. The attorney that I went to here told me that he had never done a case from ES and that he would need to talk to someone else to find out info for me. He did tell me that after we marry and submit the I130 form that we will need to wait 1 1/2 to 2 years. I think that seems like a long time. Is that the norm?

Hopefully with no hold-ups you can get through a bit quicker, at least to get an appointment.
You can do USCIS and NVC in a year probably and then wait a couple months for an appointment, then just wait out the waiver processing times which is on the average 6 months maybe a little bit more hopefully less.

well it all depends on wehre you are filling your petition.. vermont is the slowest as you may have already heard but there cases where getting transfered to California Service Center. In California service center is quicker... we started in january & if its wasnt for the police certificate that toook so long to receive our case could have been completed in early august & we would have been getting an appt in november but we probably wont have one until dec or jan so think of like 8 months to a year... plus the time your hubby has to stay in El Salvador...
