Hiii, I2US! I missed you all when I was on vacation. Trying to catch up and see what I missed ...
Meantime, I had the bright idea of scheduling an InfoPass appt. at the Houston office for the very day we returned. I almost wimped out, thinking it was a bad idea, but ended up going down there anyway. (I didn't make my husband go, though. He got to stay home and paint the fireplace. I think I had more fun at USCIS.)
Anyway, I only had to wait about 30 minutes for my appt. to start. I went to the counter and met with an initially EXTREMELY RUDE immigration officer, but after throwing a bit of a fit (I'm getting really sick of this s***), I was able to get some useful information.
(a) THEY NEED YOUR ACTUAL FILE TO DO ANYTHING AT ALL. This is EXACTLY what Jveli said in a previous post. They cannot proceed if they have just a copy or just a receipt. They need the entire ORIGINAL physical file. So that's one reason why they haven't scheduled us for an i-130 interview yet: our file was still at the trial attorneys unit in Boston, where all my husband's hearings are being held.
Our lawyer had previously assured us that the file wasn't sitting in Boston (I'd asked her after I saw Jveli's post), but it turns out she was wrong. So when I left USCIS, I called her up. She then called the trial attorneys unit to see what was up. The woman there told her that she was looking for the request for the file from Houston, and that Houston had forgotten to request that the file be expedited. She told our lawyer that she'd do us a favor and expedite the file nonetheless, and it'd be in Houston in a couple of days.
(b) "YOU SHOULD HAVE YOUR INTERVIEW SOMETIME IN SEPTEMBER." This is what I'm trying not to get excited about b/c I've heard some people say that it takes up to EIGHT MONTHS to be scheduled for an i-130 interview. But I explained our situation (my husband's next court hearing is in October, and we REALLY need to have our interview before then) and the heretofore extremely rude immigration officer (HERIO) asked me to sit down and write a letter to the director of the Houston field office explaining everything. HERIO said that since we have our hearing in October, we should be scheduled for an interview in September. HERIO said this matter-of-factly. In fact, HERIO said if we WEREN'T scheduled for an interview by then, to make another InfoPass appt. and alert them to the fact.
Should I be excited about this? Or do you think HERIO is blowing smoke up my rear b/c I threw a fit and she was trying to appease me? I'm too jaded to get too excited, but ... I can't help it!
