hi all!

been away for a while, just want to know the process back so i won't lose any more time processing just in case. location: manila.
my case - my LPR wife was an employment-based visa beneficiary & i was a spouse derivative of that petition. i had a previous overstay so i submitted i601 waiver after denial in the interview. waiver got denied and didn't have enough time (& spirit) to do an appeal. i got 10yr bar.

one year later, just passing by here & read about gracey025 success. got a li'l excited again w/ the process (maybe better consulate now, compassionate - wishful thinking(?):)).

now, i just want to know how to restart the process again? file what/ request what? is the old petition still valid? do i still get/retain my previous priority date? 2008 visa bulletin for philippines, EB3 is unavailable & F2B is way back aug 2003. it does not look good & i don't think it's going to get better sooner (hopefully t'm wrong). if they're going to get me another priority it will really hurt.

please guide me to this process/journey once again. i just don't want to lose any more time to this.

Hmm... In Mexico at least, many people have been able to request a new interview by contacting the consulate. I'm not sure if that is possible in Manila. Also, it might be more complicated since your wife is an LPR already - I'm not sure if you are now subject to the visa preference category since she is already (I'm guessing) working in the U.S.

I would suggest you consult with someone like Norma Ayoub who I believe does more employment cases as well as waivers. ayoublaw.com
