Hi:

My long-time boyfriend was just turned away at the airport trying to enter the country. He had overstayed multiple tourists visas, and so he was given a 5 year ban on reentry. He is Italian.

Was he technically deported?

How will the CWOP affect his getting back into the country?

Should I go to Italy and marry him? The guys in customs told him I could and that there was recourse.

What forms do we need to fill out? Do we need to prove extreme hardship?

I know I need to talk to a lawyer....

You'll find the waivers section very helpful. I believe the proper terminology is "denied entry" as he didn't actually enter.

Yes, it's not a deportation. A five-year ban is sort of strange - it's usually 10 for more than an aggregate year of unlawful presence.

Anyway, it sounds like if you marry (or file for him as a fiance) and get to the visa interview you will have to
file an I-601 waiver through Rome before he is given a visa. It's actually faster if you file as a fiance. Check out the I-601 other countries section.
