Hi:

My long-time boyfriend was just turned away at the airport trying to enter the country. He had overstayed multiple tourists visas, and so he was given a 5 year ban on reentry. He is Italian.

Was he technically deported?

Should I go to Italy and marry him? The guys in customs told him I could and that there was recourse.

What forms do we need to fill out? Do we need to prove extreme hardship?

I know I need to talk to a lawyer....

if he overstayed he might need 601 and also 212 for his deportation please look into the documents he recived and wht are the inamisbilitys that apply to him .

in any case look in to 601 forum many ppl have posted their hardship letters for 601 both 601 and 212 can be applied at same time and can be approved simultaneously.

you need to marry him apply for his i-130 ad K visa and then he need to go for interview where his visa will be denied and asked to submit his waiver application .

you will find lots of useful details in 601 foum if he dosent have overstay of more than 180 days he will only need 212 in which case you have to apply either along with your i-130 or send it to district office where he has been deported .
