I need help to understand my wife´s situation. I was deported 6 years ago, she did not want to stay in the US alone with our children so she left voluntarily, she has no case, no record with immigration, she returned to be reunited to the country where I was deported. About 3 years ago she returned to the US on a B1 / B2 visa, she was granted a visa tru a I-212 waiver because our daugther has Down Syndrome, serious heart condition and tyroid´s problem. Then after six months they returned to comply with her visa requirements.

Both of my children are US citizens, my son attended an american like school but last May 2007 he was not allowed back because we can not afford it, he is not allowed to enroll in the school system here because the school where he attended (the american school) is not accreditted so nothing is counted toward his education, our daughter has never attended school, there are no medical facilities for her, no insurance will cover her (pre-existing conditions) no therapy and her spanish skills are zero, so even they were school she has not been able to learn spanish.

Recently (one month ago) my wife was given a visa again because our daugher needs to be seen in US by her Doctors. They are over there now, but my wife is afraid to return because there is no future for none of my USC children here, (ages boy 15 girl 16). so she wants to stay in the us but legally she is terrified of being on deportation procedures, she only has 5 months left to get a work permit or a parole or something that helps her to remain in the US legally. We have made the toughest decision to separate for my children sake, we hope the sacrifice is worth it, but in the meantime she needs help to get a work permit. She has Bachelor in Business Adminstration, and a lot work international experience

You could always try to request one and see what happens but if she stays illegally and is deported it is possible that she will never be granted a visa again.
