Hi All , I was wondering , if someone has a waiver approved , does this approval remain for any further waiver requests ? i mean , can they ask for another waiver having previously approved one ? thanks .

I am unsure about what you are asking. The waiver is only for spouses or fiancees. So, if there previously was one approved, then why would you need another one? Do you have new spouse or fiancee? If so, I believe you would need another waiver. Because each waiver is different you would again have to prove why it's necessary that THIS beneficiary must be present with you in the US. I would imagine with each person you would have different hardships. And, from the time of your last waiver things may have gotten better or worse. So, you have to start all over again and tell your "story".

:ditto: to what Rinner said. Also, there are waivers for Immigrant visas, and waivers for Non immigrant visas. But those are different too. Because once a spouse get approval for the immigrant visa, he or she becomes an LPR--then no more waivers would be needed.

hi , thanks for your reply , well , i had a waiver approved in 03 , for a non imm K-3 visa . I had an interview last week in UK , i was denied again ...but then told by the waiver officer that once a waiver is approved it stays for life .

Andy, this is a very odd situation. Are you applying using the same spouse or a new one?

Did you enter after having the original one approved?

Did the waiver officer (in the end) win out with his/her opinion?

If not, what was the final verdict? What paperwork did they give you?

hi , yes same spouse AND 2 children. I was given the blue denial notice , this requested further documents ..mom in laws proof of cit and a full I-864 .... the waiver officer drew a line through the denials for cimt and overstay ..he said i dont need a waiver as one was already approved .

So all you need to do is submit the documents they ask for, and as long as it is complete, they will issue your visa.

These documents should not really be difficult to get. The waiver should still be valid, like the waivers officer told you, so there should be no issue as long as your sponsor makes enough and your MIL gives you the Proof of Citizenship (this seems like a weird requirement to me). . .lots of times they will even take your passport at the same time as the requested documentation. If all is valid, shouldn't take that long get your visa. . .just keep in touch after submission.

hi , the paperwork they requested was never forwarded from NVC ! luckuily my lawyer has it and hopefully it will be with me this week . I have to arrange for a courier to collect and return from the embassy , standard procedure with london , ill keep you posted , thanks .
