crossed Canadian Border 2 years back n still in USA

some1 i know was sent back from Newark Airport (NJ) back to her country, she has a british passport and she is from Scotland, she was travelling back n fourth and finally they caught her n told her she's been overstaying her visa waiver, she was sent back, well now she is in the USA, i think she crossed the Canadian Border, now residing in FL. she has 3 American born sons, and after getting back into the States Illegally, she had a baby girl. She crossed without inspection, what are the possibilities? can she get into trouble? Her hubby isn't a citizen either. What are her chances? Can they chuck her out the country if they find out? Will she be able to adjust her status in the US in the long run?

She is absolutely deportable, and if her husband isn't a citizen they don't really have any options. Is he a permanent resident at least? He could file for her at least if he's a resident but because she EWI she'll have to leave the U.S. and consular process - no adjustment of status. And actually, if she had more than a year of overstays on her visa waiver before the EWI, she will have to wait outside the U.S. for ten years before she can even file a waiver. Not a good situation. Sorry.

From what i've heard he isn't a permanent resident either. They both have no papers. But, all her children are American born citizens. age, 9, 7, 5 and 1 year old babe gal.
