Hello Everybody...
My petitioner has become a USC and I want to know how this can help me.

I'm in Mexico and my priority date is for July '94...I'm almost 28 yrs and single (I live with my couple and we have a son, but we're not married).

do you think this change will help me to get the visa soon?

please help!

yes. you become immediately approvable for visa. I think you have to resubmit the application I dont think it switches automatically.

Well, who is the petitioner to you - sibling? You don't become immediately eligible unless that petitioner is your spouse or adult child. Obviously those two options are impossible.

Please someone correct me if I am interpreting this incorrectly.

You were a 2B preference, and now you are a first preference. Whether that is a benefit or not really depends what country you are from.

That is correct, Laura. But Zidane, you should also know that you have the option of remaining a 2B. Sometimes the 2B category is better than first preference so you can opt out if you like as long as you don't get married. Other thing is when the petitioner has naturalized, the beneficiary can get married and their spouse could immigrate with them, assuming no inadmissibility issues. This would be in third preference. Unfortunately, your category isn't current, but you still should keep watch because the dates can jump.

Zidane44... I was told by my lawyer that if my mom was to become a USC my visa would become availbale right away. my mom filed for me since 2000 as PR so I'm still waiting. Can someone explain why is it worse being 2A?
Edit:
And you don't have to resubmitt the application. your mother sends in natur. certificate along with a copy of your I-130 approval notice... at least this is what my lawyer had told me

Mexicans have to wait a very long time, other Hispanic countries have a less time of waiting? Where are you from?
In your question did you mean 2B? The category 2A is for spouses and minor children of legal residents. 2B is the category for children over 21 single of LPR. For Mexicans sometimes the second or third category is at this time moving a little faster, but not always.
Are you in the US or in your country?

Zidane, unfortunately, Mexico like Philippines, China and India is in a category that is exempt from numerical limitations. if you check the Visa Bulletin for Aug 2008, Mexico's F2b has April15 1992 priority date and Family first (F1) is Aug8, 1992... So, if I were you, id stay under F2B category rather than going through the process of filing again based on F1... Under F2B your wait would probably be at least another 2 yrs (just guessing)... Let me tell you patience is a virtue...
If you read my very first post under this category/thread, i mentioned abt the 11 yrs of wait for my priority date to come out... Its surreal once you see your priority date eligible for AOS... Its definitely a test of patience w/ USCIS... btw, Im from the Philippines, originally petitioned under F2A and automatically fell under F2B bec of waiting forever!!!... My mother could not apply for citizenship for almost a decade now bec of us (me and my other sister) until we get our gc's... Good luck!!!

Sorry Zidane44! I see what you guys mean! I never paid any attention to other countries' priority dates. Yes I'm in US and I'm a 2B category. My priority date is Aug 2000. I'm from montenegro.

thanks! are we sure on benefiting from 245i? does a peron on deportation (supervision) benefit from 245i?
