My I130 was approved back in March 2007, but unfortuantly, waiver denied due to lack of evidence. What can i do? I have an option to reopen/reconsider/motion to appeal within 30 days. What is the best thing to do? :crying:what can one do when u don't have more evidence? instead of a 3 year bar, they put a 10 year ban on me! I'm feel very upset, no words! should i go to Canada? Hubby might come and pick up the gals n take em back to NY. I am stuck! :dunno:Please could some1 give me some good advice?

Are you sure you were denied? It kinda sounds like you were backlogged, if thats the case then you can send more evidence... if you were really denied you can ask for a new appointment.

yeah, i got the denial letter from the US embassy London on the 25th of June. new appt for what? they only gave me an option to appeal. or reconsider the case.

if you were really denied you can ask for a new appointment.
I know you can refile in Ciudad Juarez, not sure about other consulates.... anyone know for sure?

You can ask for a new appointment and resubmit your waiver with new evidence, if you appeal its a much longer process.

sure, thats what my attorney will do i assume, motion to reopen or reconsider with more evidence. The prob is hubby doesn't have further evidence to submit along. Dunno where that will lead us to. :cry:

You could do a motion to reopen, but most people (although im not sure about your consulate) request a new appt and submit a more prepared letter. How was the first letter? you said a lawyer handled it, maybe you can have a consultation with laurel scott and she will be able to tell you if you have a chance or not.........

well, the 1st letter wasn't all that, they want hubby to prove more hardship, tahts why i was denied. I didn't let a lawyer, but now i need one! Its like a never ending thing!

Kids going back to NY end of July or 1st week of August. I'm moving to canada while appeal is in process. YIPPEE!!!

I am still very sad about your denial, especially as it so obvious to me that yours is a case involving real hardships. If it wasn't a real hardship, then your busband would already be with you and your daughters (wherever that was). Instead your kids are being separated from thier mother. It seems to me that you have real hardships that need to be much better demonstrated.
Once you get to Canada get that real hardship letter underway.

I did not send additional evidense because I misunderstood the 30 days and 10-12 month processing period. I tought I would get a letter within 30 days and then I could submit additional evidence throughout the 10-12 months processing time.
Now the 30 days are up and I didn't send additional evidence. My hubby consulted a with an attorney and they told him that I would be denied and placed with a ten year ban.
I don't know what to do. I have lived in the US since I was 10, I'm now 23.
I feel as if my life is over.
