View Full Version : Can I still submit a petition without his name on the BC

I love it how I am the only one so far that has posted so many ??'s in the I-130 part. I feel like a pain in the butt.
Anyways....I am sending in petitions for my husband, step-daughter, and step-son. My husband is not listed on the birth certificate for his son. Is this going to be a problem?
I don't think we can add him unless we go to mexico to do it and right now we can not do it. Can I still file the I-130?
Anyone know how I can change the Acta de nacimiento for his sone from the US?

I became friends with one woman at our local Mexican consulate. I would suggest giving them a call and stopping by and keep questioning. They will usually tell you they can't help but after seeing you a couple times they will realize you are not going away.

The Mexican consulate won't be able to help with any issues regarding US immigration. But if you want to know if it's possible to make a change on a Mexican birth certificate from the US, they *might* be able to help you. I would also read through the I-130 instructions to see if it provides any information regarding what the bc needs to show.

I just got off the phone with the Registro Civil and that didn't work out. The guy didn't speak much English and I don't speak enough spanish. It is so stressful. I want to add my husbands name to the BC really bad. i don't care if I have to pay the increased fee for the I-130, but this little boy needs to come live with us because he mother treats him bad. I believe his name has to be on the BC because in the instructions for the I-130 it states you have to prove my step-mother status and that is through my husband in which is not listed on the BC. I called the Consultate and emailed them and no answer. just voicemails and no replies. When I get time off from work I am going to drive there and talk to them I guess. I am all ready with the form. It is all filled out, but there is no need for me to turn it in. Thanks for helping guys. If anyone knows how I can change the BC let me know. I am so stressed out right now.
