View Full Version : Can u return when bar is over if waiver denied?

Does anyone know if you can return to the US if you're waivers are denied once your bar is over? I beleive this is true. What is the process? Do you reapply, go through years of background checks all over again, how exactly does this work? This would be my only sure hope if we are denied, I am just trying to prepare for the worst.

I think in this case ONE won't need a I601, but will need to file I 212, for a deportation (if any). But, what I heard, I 212 is easier to approved, however, if both waivers are required, the hardship letter is just the same as hardship for I601 (EXTREME HARDSHIP)
I'm sure someone knows this process better.

Yes, we've had a couple of members do that. Waiver was denied (the one I'm thinking of had a 3-year bar, no deportation). I think you just need to request a new interview with the consulate and that's it, you should be issued a visa.

If there is a deportation as well - for a 10 year bar that is up, the deportation bar would be over too. For a 3-year bar, I suppose you'd have to file the I-212 since I think you'd have a 5-year bar for the deportation.
