How could someone know that they have been charged with CIMT or Misrepresentation or even both????

Is there a form that is given to alien stating what he or she is been charged?

Can one be cleared of these charges regardless of the circumstances of their removal?

I'm not sure of misrepresentation but I know the CIMT I believe you get it when you are charged with a crime. For Mexico, CIMT is checked off the form before you file your I601 waiver. My husband has this CIMT but we knew that going in and it was checked off his form.

You can not know officially what you are charged with until you go to the visa interview and then the CO will tell you why you are ineligible for the visa and if you qualify for a waiver and what type of waiver. Fraud/Misrepresentation is when you try to get an immigration benefit with documents that are not yours/that have been doctored, or you make a false statement to an immigration official/or on an immigration document.

Or even if they suspect you are guilty of any of these things, they can deny your visa.

I agree with Pinkpig If you are charged with misrepresentation it will usually be under 212 a 6 c i or c ii if it is a false claim to US citizenship.You file a waiver under 212 i or 212 h if you have a criminal history.

None of this applies...I guess it is just about illegal presence in the U.S.

You would not know until the consular officer tells you at the interview, and they should give you a sheet with your ineligibilities listed.

Misrepresentation can be the manner in which you obtained entry to the United States. If you know that you lied on any visa application about any "material fact" then you will be charged with Misrepresentation. . .same goes for verbal declarations. . .if you have been deported, it will sometimes, in the case of expedited removals, be noted as a charge on your deportation papers.
