View Full Version : Returning after deportation for overstaying

Not quite sure where to post this. My husband and his brother entered the U.S. on visitor visas from Morocco in the 1990s. We're pursuing adjustment of status for my husband, but my brother-in-law was deported back in 2003. Is there an automatic 10-year ban on his returning to the U.S. for a visit? My husband said he'd heard something about a 6-year ban and we're trying to figure out what applies in this situation.

Since he had overstayed for more than a year, then yes, when he left, he triggered a 10 year ban.

Thanks for replying. That's what I'd thought, actually. When my husband mentioned a 6-year ban, I figured that must be wishful thinking on his part since it's almost been 6 years.
Do you happen to know if, once we reach the 10 years, the process for getting him a visitor's visa will be the same as for everyone else? Or will he have to jump through extra hoops since he was deported?

To be honest, I'm not sure if he will have more forms to fill out but I'm sure others will chime in
