Anyone know how you can quickly leave the US and have INS know it and give their blessing so it's documented??? :innocent:

My wife was just informally denied her petiton to adjust status here under her parents because she was over 21 when they adjusted status. My wife has an I-130 interview in Guatamala in 1 week and we are getting ready to leave. I dont want any problems later trying to prove she left the US and I definately dont want an order deporting her when shes already gone.

Save the plane tickets (boarding pass).

Yeah but hoping something better. (Also bought round trip ticket for wife because that was only way of getting her and I on same plane on short notice; that wont look good).

I remember from a Laurel Scott chat that she recommended someone set up a bank account in Mexico (or Guatemala) or wherever they are going as soon as they get there so they can show they have left.
But has she been given voluntary departure (deported?)
If not, it would seem pretty standard that she leaves when her appointment comes up.
Also, if you have your interview in Guatemala in one week, they will definitely know she is in Guatemala, right? :)

:ditto: to Cherokee.....I doubt you will have time to see a judge (or request one if that can be done) on such a short notice. You can get proof from the airline that the return ticket part wasn't used. (Flight manifest)

I don't think you'd want to actually go for a "voluntary departure" unless there's a deportation situation happening. My husband just made sure to keep his plane tickets and we've copied the related stamps in his passport that show the date he landed outside the US. Save everything that can prove presence outside the US in case there's a question about it. I don't think you need to go seek out ICE for this... eek.

Yeah, the fact that she's at a consular interview in Guatemala is pretty good evidence alone! Just try to have her keep documentation of her presence there all along the way until she gets to return to the US. Bus tickets, bank accounts transactions, phone records, whatever...

i would definately keep all records while she is gone. should not be a problem as long as she is still in good status
