My last email from Vienna was in the beginning of July and had them @ 6months backlog & holding... In July they were working on January waivers.

Have you heard something more recent that has their timeline improved?

Yep I just received a email from Vienna today and they are just starting April Cases. Good luck to everone with case in April and to everone else too.
My husbands case is in the end of May. I hope they work fast

That is great news! I hope they keep up the pace they are on now- that is pretty quck from what I heard in July they said they were on January waivers...

Good luck on getting some good news about your husband's case very soon!!!

I just sent some updates to our case, so I'm glad I got them in before they start reviewing...

One last questions... I called the FBI a couple of weeks ago to see if they were done checking my husband's finger prints and they stated they never received them for processing- is this normal considering he submitted them in May @ the embassy?

I'm not sure about the fingerprints. I know that the Embassy sends them to Vienna First after that i have no idea what happenes. Maybe you should ask Vienna. Good luck

Thx... I emailed to ask them on Friday about the prints & send some new documents, already got the out of office holiday email for labor day.

We should all be hearing @ almost the same time, they clocked our waiver in the first of June.

The Vienna thread has been dead for a while. Glad to see there are some filers other than myself for Vienna on I2US.

hi everyone,i just wanna tell u i went tru Vienna/Rome office 2 years ago,and by reading ur coments i guess not that much has change,it took me 3 months to get my waiver approved even though they said it would take 6-12 months,but u know what i keeped calling them every single day so i sugest u do the same :)))))

cindy101, I'm gld there are a few more of us from Vienna too. I know i haven't been on I2US in a few months things just got crazy. But Now i'm back and hoping and praying like always that Vienna gives all of us Great News. Godd Luck to everone.

I compiled a bunch of stuff before I contacted them (last in touch w/ them July 1st..

New documents to add to hardship...
& I also, inquired why the FBI has not received my hubby's fingerprints for processing yet- Vienna should have received them June 1st w/ our waiver packet from Vienna. Checked w/ the FBI again today- nothing yet!

Just heard from my hubby that they did a big cleanup @ the US embassy in Albania up to & including the embassador (that could only be a good thing for anyone needing to go through there)!!!

I don't know how different Vienna is compared to the Consulate in Juarez, though once I received my Approval Waiver, I did call daily to see if my file had been updated. I spoke to a different person each time I called. I also emailed frequently, and from the responses I received, a different person responded.

Unfortunately, these things take time...often longer than sometimes we feel we can bear...wishing you all the best of luck!

I feel the same way Ginger. I email Vienna once a month i try for the end of the month that way i hear if they have moved onto the next month. When i know they are working on the month that your cases is in i email them 2 or 3 times to keep up to date.

Yes.. I never thought they'd stoop to lying but they did... So good riddance to the whole lot of rotten apples.

I'm glad, a lot of people beyod myself must have complained.

I know of a few people who where fed up with that mess. I hope things change because it won't belong before we hear something from Vienna, things move back to the Embassy.

Learn something new each day... There is more than one FBI location that runs prints- husbands had already been submitted & have cleared!

Vienna is now on April waivers...

Hi Red,

You are end of May... I am the very first of June- so we should be hearing from Vienna at almost the same time.

According to the the info I received today... they will be adjudicating our case soon.

So I'm going to keep praying- for my family and for everyone on this site.

Hey everyone, my SO is Albanian and our waiver will be sent to Vienna.

Just a word of warning for those that have waivers filed in Vienna. Don't be surprised if they forward your waivers to Rome or Frankfurt. Our case sat in their office for 5 months before they sent it onto Frankfurt for final adjudication. They said they were dealing with backlog and it would be processed faster in Frankfurt. This happened in June, 2007 (this year). We have since got our approval (from Frankfurt) and have moved back to the States! Best of luck to everyone!

I also don't know why... but it seems like certain countries are the ones to get bumped to Frankfurt and others remain in Vienna... Anybody else notice that? Must be some method to their madness.

Hi everone, I haven't really noticed that but also haven't been online for a few mouths ether. What countries do you think are getting bumped to Frankfurt. I've only talk to one person from this website who start their case in Vienna and then it was sent to Frankfurt and that is where she was from.

Seems like when they get overloaded in Vienna, waivers from Czech, Poland, Albania, & Romania go over to Frankfurt.

My husband's case is also being processed in Vienna. I just got an update on Friday that Vienna is just finishing April and starting on May. Lets hope that they keep moving at this rate!

This has all the historic information that people on the site have given so we can all have an idea of approval rates for different causes at the different embassies. Pinkpig has this posted on the I-601 Mexico Forum. Make sure you read the stickies there as well as 'all other countries' for good information.

Cindy101,thanks a lot.These informations are very hopeful. I see that most cases are based on overstay,but also i see a lot an approvals based on misprepresentation. Of course, depends of luck and what a strong waiver they had. Thanks again,keep touching.

Cindy101,i forgot to asked you something. I also saw that you have an waiver for F/M. What kind of F/M? Do you used lawer, do you have strong waiver? Cindyyyy, I'm squaredddd.

Hi Dana,

The F/M is due to passport that was used.

I pray our waiver package is strong enough, I put 3 months of my life into putting it together.

Did use an attorney, and the resources from this site to put my package together.

I'm scared too... we all are.. so let's stay strong and hope for the best!

Cindy,we are in the same situation. I also need an I 601 for the same think. Really I'm squared because my husband is romanian/american through naturalization and we don't have medical level, just letter from psychologist. We need a miracle, just God can help us.

I'm really getting scared now. i emailed Walter in Veinna yesterday to ask about my husbands case, but there was no answer today. He always emailes me right back. My friend had told me that she didi not here any thing from him and then one morning she got a email saying that her husband was approved. I pray to god that is the next emaile i get.

I pray that we all get approved.

One last comment.. I checked the calendar- the did observe Columbus day Monday- so maybe they extend the holiday?

Also... Some terrorist nut job tried to do a suicide bomb on the US embassy last week in Vienna. Thank God nobody was hurt- but the embassy may be in lock down/ high alert... not sure.

Sorry for not responsing, I was in RO visiting my wife. We have not heard anything yet. I contacted my rep. she was going to put in a call to the consulat, I dont know what good that will do. I dont want to bother W. right now, or maybe I should? I will post as soon as I hear something. Pray is all we can do.

Dane- I think she is a fair person. I had a very big issue w/ the embassy in Albania, so my I-130 had to go through Vienna.

The Officer in Charge (Marla Belvedere) overturned the bad decision made in Albania in under 10 days last December.

I did send in a complete and comprehenisve rebuttal, which I'm sure helped- but unlike the US embassy in Albania, Vienna actually reviewed the evidence in and made decisions based on facts instead of their personal feelings.

Anybody hears anything from Vienna, please post! Good luck to all!!!

My guess is they fell behind because of the day off and the incident @ the embassy.

NGCOMan will be hearing something very very soon then since he had a beginning of May date.

I spoke to WS, in Vienna. He said that our case in pending, they are waiting for some file from the DHS. I guess its the I-212. THey are working on MAY 2007.

In our conversation, WS did mention the fact that they are required to answer all calls and emails. I guess that would slow the productivity.

If only.... the US Embassy in Vienna would put the info. up on the web like Rome & London every couple of weeks so you could just see the progress of the cases.

Unfortunately, email/phone is the only avenue of inquiry @ this time for that embassy.

We filed a motion to reconsider and forwarded it back to the originating adjudicating office as stated in our denial letter from the AAO. The originating office was Vienna, Austria. We followed all instructions and submitted all documentation to the DHS in Vienna on February 3, 2007. I called Vienna to check the status on our case and was told the his case was no longer there and was sent back to the AAO in Washington for review on September 21, 2007 . I am very confused. Does anyone know why it would be sent to AAO?

Any response would be appreciated.

Well,

If you appeal it goes back to the US for admin review... If you refile it gets re-adjudicated by a different officer at the same embassy.

I've seen multiple postings where it is a lot faster to just re-file w/ a stronger waiver, but can't say from personal experience

I'm sure some others will reply as well!

I heard from somebody else I know going thru Vienna/ Albania. They just got a medical expedite approved. So they are working away over there...

Keep the hope alive, maybe our turn is right around the corner.

Our 601 was turned down, we received the letter today. Im not shure we will appeal, we have 16 mo to go before the 3 year is up. Im not sure we can come up with anything that would make the 601 letter any stonger.

I am so sorry to hear that!!! That is very disapointing news, my heart is very sad for you and your family.

Did they say why they didn't approve your case?

Was you I-212 approved?

If you post the letter (taking out your personal info of course), I know people here would give you advice. A lot of people went thru Romania, maybe some things you didn't think of... couldn't hurt and could have 9-10 months off your wait.

Ngcoman, i don't have words. Really, no words. I'm from Romania too, my waiver is to Vienna and in a few months i will know the answer. Really i don't want to imagine a negative results because is HORRIBLE.

Thank you guys for kind thoughts. At this time I think we will let the 16 mo go by. I do have a question, all the NVC stuff and all the paper work that we put together for her file which is at the consulate will it still be available at that time, and is there anything I need to do to keep it current. I know while dealing with the NVC you have to keep the case active, dont know if it is so with the case at the cosulate.

I understand... this process can totally suck the life out of you. At least you know in 16 months (even though it is an unthinkable amount of time to add on to the time you have already been apart) that there will be a happy ending and that your wife can come back.

Stay strong... I hope you'll at least get to go visit once or twice, and I hope she's hanging in there ok.

As far as keeping you case active.. I think I saw somewhere that you just have to call in or email once in a while so they don't close out your I-130 and you have to start that from scratch... but I'm sure somebody will chime in w/ details.

Fresh news just in from immigration liaison.

"I got a response from Vienna. They said that they are finishing up the waivers filed in May and expect to begin adjudicating the ones filed in June this week or next."

I will double up the prayers for all of us!

I also received a email from Veinna
It states " No news so far (on my husbands case) and The officer in Charge will return to the office next week, thats when we will continue with case adjudication." I plan on emailing again on Nov.12th. I'll be praying for all of us as well. Good Luck

Yes, towards the end is the most frustrating and all the what if's and doubts. But once you have the approval, all the waiting and the whole process seems to not matter so much anymore.

We applied at Warsaw, Poland then forwarded to Vienna. Did you guys get a case # from Vienna or they're using the same USCIS numbers?
I'm planning to email to Vienna about my case but not sure what numbers to reference it to. :confused1:

we have no case #, We email Walter in Vienna and he lets us know what is going on. When i first started emailing Vienna I would use my husbands full name and A-#.
I'm not sure if that is who Cindy did it, but she let you know if there another way that i'm not sure of.

The first time I emailed Walter I used the case number we got from Tirana- starting in TIA... Vienna had no use for that number. Stick to the Alien # A- like Becky said, and reference your spouse's full name as the beneficiary.

I'm a little extra neurotic because there was just a denial from Romania... An expedited Albania for medical (but that was processed through Rome).

Magicfly99, my waiver is also to Vienna. Cindy has right, we have a pretty close timeline. Vienna recieved my waiver on 17 Octomber. I will pray for you.
Also I will pray for REdaja and for Cindy because Vienna will start to adjudicate their cases. I know that God help all of us.

Im So glad that they are on almost on June.. my papers are from November because the embassy told us to send them to Detroit, and detroit sent them to vienna after almost 4 months.

cindy101, I'm curious where you found this information that Vienna never gets behind thier six month time frame? I would imagine that the process can sped up or be delayed (meaning it could take less or more time than 6 months). My husbands waiver was forwarded onto Frankfurt Germany after it sat in Vienna for 5 months. They forwarded it onto Frankfurt for final adjudication, saying it would be processed faster there.

Vienna themselves... this is their consistent response, and based on filing dates and answers on the board, they seem to maintain:

"At present, we are adjudicating applications from January 2007, maintaining a six months timeframe for I-601 waivers."

Unfortunately... Alitalia has held my husband hostage for the last two days.
My parents bought his ticket, as their Christmas present to us. Alitalia assumed therefore it must be a fraudulant purchase and suspended his ticket on Monday.

Monday my mom, who is currently down with my sister who has cancer in Kentucky, ran to Fed Ex Kinko's to fax a copy of her DL and credit card and statement of authorization to Alitalia theft prevention in Italy. Alitalia said this is the only way they would lift the suspension on the ticket. They never did!!!

Alitalia confirmed receipt of fax @ 4:10pm Italian time, but didn't bother to call Albania to lift the suspension or change it in the computer... So again no flight out on Tuesday despite every member of my family screaming at them as well as American Express.

Today I woke up @ 5:30 am(11:30 in Italy) determined to resolve this and get my hubby home (after 19 months separation I was not nice)... Still nothing had been done to lift suspension.

I advised them if not resolved by 9am EST US that I would take Am Ex up on the offer to wire my husband money and have him leave via British Airways and leave it to Am Ex to get their money back from Alitalia.

Worst customer service ever! They suck! Never ever ever fly Alitalia. No word yet from my hubby, he should be @ airport now... left his cell w/ his family... I just woke up his mom. No call means good news, boarding flight- so I am going to hope for the best that he will be home 6:30pm tomorrow.

I am leaving a 5 hr layover in NY because I'm afraid of the "secondary processing" w/ his new visa and the mysterious "manilla envelope" for DHS.

Sorry for the rant... but after 19months separation- we just didn't need this icing on the cake!

My husbands waiver was received in Vienna from US Emmbasy in Skopje Macedonia in june 22nd, I called Vienna yesterday they told me that they waiting for a file to receive it from USA and they going to make a decision. I am excited and cant wait till this long process is over!! My husband he is Albanian from Kosovo, He voluntarly departit from US to Kosovo just 1 month before our first baby was born. Hi Cindy I was gonna ask you how did the US Embassy in Tirana informed you that they grant your waiver, did they send you e-mail or they mailed a letter to you, and how long it took after the grant to get the visa and get in a plane how many days, thank you for your response, because someone told me that after a grant you have to wait two months to process the visa, I hope thats not true.

Well..

First I heard from Vienna via email that it was approved & that Albania had everything they needed to process the visa.

Then, I emailed and faxed, and called and emailed and faxed and called... and at the end of the day I think Albania got sick of hearing from me so they called my husband and had him come in for the visa.

W/in 2 weeks of his Vienna approval he was back in the USA.

Depends on how busy they are and how pushy you are I think.

They will be very slow w/ things if you let them (Albania, not Vienna).

Vienna very timely.

I have called Vienna today they told me they did receive the file from US on

thursday, but they say my daughters birth certificate was missing and

another application, I know for sure that my lawyer has complete everything

and, I know for sure my husband when he went for the intervew he did send

our doughters birth certificate and all applications to the US Embassy in

Skopje Macedonia, but what they did I dont know, I am going to call my

lawyer and tell her what they doing I am so ......?

send it until they ask for it, anybody can tell me because I dont gett it why

they hold my doughters birth certificate there, and they didn't send it with

waiver to Vienna, and they say they going to send it with fast mail, and they

told me ask Vienna if they need something else we send it with fast mail, and

Vienna also aked me about form G-28 I have to tell my lawyer for that.

Cindy did they asked you for that form G-28, Im going to tell my lawyer to

send that form to Vienna and I'm going to fax it my doughters birth

certificate to Vienna hopefully I get aproval soon good luck to all of us.

Please, make contact with Senator Levin. They did helped me. Laurel Scott is great. She had many waivers in Vienna and Frankfurt. She can help you. Did you think about her? If you don't want to hire her maybe consultation with her will be helpful. Do you trust your lawyer? What was the reason you were denied? Do you remember Sylvia? Sylvia's waiver was denied two times in Vienna but they were approved the third time so don't loose hope. I am sorry it is taking so long time for you. Only persistence works in your favour.

My husband is now in Albania, when he came to the US he came with someone else passport and that is why we had to do the 601.... I did the 601 with a lawer so i hope everything was fine....

Why dont you start your 601 so you can have it ready? we hired a lawer and even with that there was a lot of work to do so.... i would sugest you have it ready.

Becky- I am glad that you will be able to file again so soon. You are DUE for a major change in luck here!!!

Olie- I had to wait all of the standard times (6 months for I-601 review). We got hosed by the US Embassy in Tirana over our I-130 and they made us go thru Vienna.. and even after Vienna approved it they made us prove even more before they would accept the I-601. So that part of our timeline is what took the longest. Receipt date of waiver to decision is usually 6 months.

They are usually more brutal and take more time if you have to do an I-212 along w/ your I-601.

My husband refiled the waivers today. Good news for others who will be filing at the US Embassy in Tirana there is NO charge for Fingerprints now. But you have to pay 65 eruo (about $100) to send your waivers UPS. Good luck to everyone who will be filing soon.

Olie i'm sorry to hear that. Why did you appeal why not just refile? Its faster and you get a new start on everything. It make sme so made that Vienna Denied you. Don't give up keep fiting.

What frustrates me the most is that they denied you because he used someone elses passport. My husband did as well, but what do they expect. At that time the country was under a dictator. It is so difficult to get a visa if you are from Albania they look at where you are from and your visa is denied. If someone needs to get out they get out no matter what they need to do. It is out of desperation and desperate times call for desperate measures. I am afraid now that we will be denied for the same reason they gave you... I wish you all the luck Olie

mosaic dont worry... it depends who looks at your case and your hardship....
you know we can keep on trying and trying we will never give up.... For God's sake they cant deny all of us! it just amazes me of what they consider hardship.... i mean how sick do you have to be to really get your husband back... you would think you have a right since you are a US citizen but they take all ur rights away .....
I will re apply and I am hoping they will approve us this time

hi all...just out of curiosity...Has Vienna dennied all cases that people used someone else passport? Has anyone being dennied by EWI? I just want to see Vienna's patern. It seems like it doesn't matter what kind of Hardships you have....they can just deny you base on the crimes.

my husband has a Misrep/ unlawful stay. He has been denied two times. But not just for that we have not proven Exterm hardship.

Olie your rigth about what they consider for a hardship you have to dieing for them to approve it. It seem like.

OMG, I just sended our ds230, and after reading all this I'm getting cold feet, Vienna is so hard, we don't have any med. hartships. I'm scared, it's so much eazier to be illegal, so not fair, don't think it's worth trying to what?, destroy my life,family, be a single parent, who are they to decide who should be happy and who should suffer- this law sucks.

I am hoping for a change in attitude with the upcoming elections.. That this type of suffering can come to an end.

I am very sorry to hear about this Ollie- does not seem like Vienna is trending very postitive right now.

Ladies... I can only say this because I belive this is what swayed the balance for my family... Stay close to the immigration liaison at your Senator's office. Get them to feel sympathetic to your case. I feel that Vienna does take that under serious consideration.

Cindy how to get a Senator involved, who to contact, can you give me some pointers? I would love to contact my congresman or senator just dont know how? And when is the best time to bug them after you file a vaiwer or before?
