Cindy how to get a Senator involved, who to contact, can you give me some pointers? I would love to contact my congresman or senator just dont know how? And when is the best time to bug them after you file a vaiwer or before?
Well I am contacting my congresman soon. I was advise to call him and talk to him about my case and follow up with a letter. What i did I found out his phone number and address online.

Senators have more clout... go to your senator's website and look for constituant services...
Then call their main # and ask for the name and extension of the immigration liaison- that is the person you want to focus on.
I was working with the immigration liaison since I filed the I-130 and they denied it for bogus made up reasons. She really helped. She also helped a guy on the site that needed help with his I-212. If you do a good 'sales pitch' in person on the phone you can usually get some level of help.
Major point: Usually you get the old blow off the first or second time... be persistant (follow up every 3 weeks on the dot)... but pleasant at all times!!!!

Hi everyone, I got home on Tuesday night, and i'm ready to go see my husband again. When i was in Albania i email Vienna and they told me that they are now working on October Cases. So Good Luck to everyone :thumbup:.
Really strange that Vienna works at Octomber cases now, because a month ago Vienna approved my case that was recieved in Octomber.

My husband and I have been married for almost 2 years and have been trying to get him home for over 2 years. He has had a 10 year bar placed on him for an overstay, and we have filed for a waiver in Veinna. He has no criminal record and the proof of our relationship is strong. I am afraid that I did not prove my hardship well enough. I have been in treatment for almost 5 years for depression and in the last year my symptoms have been worsening since the separation from my husband. I have now been further diagnosed with bi-polar disorder. This process has been very hard on me and is only made worse by the fact that my father is dying of cancer. I am not sure how much longer I can hold it together, and am even thinking of applying for partial disablity because I can't seem to get out of bed every morning. I need to know if anyone can tell me what my husbands chances are of getting home to me. Please any information would be appreciated. I don't know how much longer I can hold on. :cry:

My friend who has a waiver in Vienna also said she called them and vienna said they were finishing up october.
I just talked to my SO and he told me she called him and told him the convo with vienna.

bipolar depending on country should be a good hardship, if your spouse is in a developing country- read my waiver... my son is bipolar/adhd, can't get the care or meds he needs in Albania.
Also, my sister had cancer and was undergoing treatments and I was going down there and trying to help her keep it together.
Go up to the stickies and look at the approved letters. I think mine will help you. My sister's cancer happened after I filed, so I added that after the fact- and her doctor also wrote a great letter.
Also- if your father is dying of cancer and you are his caregiver- you might be eligible for a medical expedite.

nope. my friends waiver is 6 months in late october...and she calls Vienna all the time, and today they told her she should hear something within a week or two...so, my fingers are crossed.

magicfly, I'm so sorry to hear that. If you reapply it take six months and to appeal can take up to a year. To reapply you will just refile the new waiver form and HSL. You will have to call the Embassy to get a appointment to refile. Good luck in what ever you decied to do. Don't give up

yes you will have to refile at the original Embassy. They mit not have received word from Vienna that your case was dined yet it can take a few day. But you can ask, they should be able to tell you what you have to do.
Are you using a lawyer?
I know its frustrating just keep fiting you make it.

:waiting: My husband and I are still waiting to hear if his (overstay) waiver has been approved and he can come back to me...we are so eager to hear news (hopefully good!) and we are expecting to hear something by June 5. I will post as soon as we find out the results. These last couple of weeks feel like they are truly taking forever!

The only thing I think would help to get stickied are the region specific approval and denial waiver letters...
Since you really need to know what the embassy you are filing at requires as far as standards of 'extreme hardship'

We still haven't heard anything from Vienna yet. We are planning to call them if we don't hear something by June 5 (next Thursday). I am expecting to hear something next week, though...it seems like the average is just a few days shy of six months, and June 5 will be six months for us, as Dec. 5 of 2007 was our waiver receipt date.

Hi samantha here is that email address that you can use to check and see if your waivers are in Vienna.

Samantha--Becky's right, Mr. Stettner is very nice and responds quickly. I think it took about 2 1/2 wks for my husband's waiver letter to be received by Vienna (his interview was around Nov. 17 and they received his waiver Dec. 5; he had it ready at his interview). I think we were notified by mail when it was received but I don't recall if our lawyer or the embassy did that. Good luck to you!

Thanks for the support, Samantha! I called Mr. Stettner this morning and found out that our case has not yet been decided. He said it could be a couple/few days or maybe more but that I could call back to find out anytime because that's why they are there. He said that they are working on December 2007 cases (ours is Dec. 5) but that they don't always take them in order because sometimes certain cases are ready before others. He did say that ours was "ready" so my husband and I plan to call back next week sometime between Monday and Wednesday. He was so polite and patient.
Hopefully I will have good news to share next week. I was so eager to know something by tomorrow. This waiting is killing me.

:dots: I called Mr. Stettner this morning (one week since I called him last) and he said that our case was actually with the officers at that moment! So they were attempting to decide upon it along with a handful of other cases. But when I asked if/when I should call back, he said it could be decided tomorrow or next week....so progess has been made, but I'm not sure when we will get our news. I don't want to call again and bother him, so I think my husband is going to e-mail them maybe Monday. Tomorrow, June 12, is six months and one week, so I am hoping we will hear good news very fast!!!

:curse: This is how I have felt since Friday the 13th. My husband's waiver did not get approved because the OIC/Officer-In-Charge in Vienna, Marla Belvedere, did not feel that we had extreme hardships, just regular hardships. So basically because of one woman who has never met me or my husband, he must remain in Romania for at least 6-7 months. We waited 6 1/2 months to be rejected. I have been so mad since Friday that I can't even believe the things that have come out of my mouth. We have already spoken with our lawyer and are probably going to refile as the appeal process takes so long. I have already begun work on a new hardship letter. We are waiting to hear back from our lawyer as to what our next step should be.
Thank you Samantha and RedAja for all of your support, as well as everybody else on this site. When I found out the horrible news Friday morning, I was devastated. I was actually talking to my husband on the computer with the videocamera when the embassy called him and told him his I-601 had been denied. What makes me so furious is that my husband came here legally, we got legally married, and he has never committed any crimes. His waiver is for a simple overstay. I know so many people who have committed fraud and got into this country easily. I also know that lots of people have kids and then use that as justification for staying here. We have been responsible and did not yet have kids because we were not in a stable situation. But it looks like we would actually have better chances if we would have had kids, even though in my opinion that is risky when you don't even know if/when your spouse will return to the US. Also, because we are lucky enough to have only minor health problems, we are not considered to be at extreme hardship. In the letter explaining why we were denied, no mention is made of the fact that I spent 6 years in college studying (and mounting up student loans) to get my Master's in Occupational Therapy, a field which doesn't even exist as a viable living in Romania. As charity, yes. As a paying job, no. I was told that I could live and work in ROM and that I would just have a lower standard of living. I was also told that the language barrier is no big deal as I could just learn Romanian, and that I exaggerated the state of the economy there. It doesn't seem to matter that I earn in a day what the average person in ROM makes in two weeks if he/she has a really good job. I was also told that my husband and I would have been aware of the circumstances of his visa, etc. before we got married, which was not true. We consulted with two independent attorneys (immigration specialists) who informed us that after marrying, my husband would be allowed to stay in country and to adjust his status (WRONG!!!) b/c he only had a C/D 1 Visa.
I had such a good and positive feeling and to have it all destroyed Friday was Earth-shattering to me. I do have several new things to include in my hardship letter concerning the declining health of my grandparents, etc. and their increasing need for assistance. But I am just so furious b/c all of this is so unnecessary and it has all been decided by one person who doesn't even live in ROM. I am going to get my Congress people involved this time after we re-file. It is so important for me to stay living and working in New Orleans due to the fact that we are still recovering from Katrina and there is a severe shortage of healthcare workers here.
Sorry for the novel but this is not even 1% of the rage I feel. :censored:

Sorry for your denial. I know how you feel. I am going through that route too. I am now in the process to re-file. The first days after denial are pretty harsh. Then, little by little you will start thinking stronger about your waiver. Our immigration officer was pretty harsh in his denial letter. He did not even consider mental hardship.
So, be strong and move forward.

My case was approved for the first time. My waiver was in Vienna for few weeks and they transfer to Frankfurt. Everything happen in few weeks time period. So, it was approved in less then 14 weeks but the whole process took 14 months. Yes, it is ironic, the approval was very fast. Even I didn't expect so fast, I was counting months... My case was for CIMT.
Because they transfered my waiver from Vienna to Frankfurt I feel close to people from Vienna and Frankfurt. It is confusing but at least my waiver was approved. I was sooooo scared.... but I am the example for the rest to be strong. I didn't want to fight. I lost hope. Right now I can smile but I remember the pain...

Yes, recovery of cancer. Like you see, we had Laurel Scott and Jeff Sapko from Frankfurt told her we have very strong hardship.

My lawyers office called me yesterday and told me that The Officer In Charge From Vienna would be out of the office, and they weren't sure how long she would be gone but that it mit take a little bit longer to get a anwser abut your case. Just wanted to let everyone know if you a waiting to hear something.

I get a email a few days ago from my lawyer stating that we should hear something from Vienna in 6-8 weeks. I think it mit take longer then that, but i'm not sure. They just told me that Vienna was working on January 2008 cases. I hope thay are right.

I have heard from several people that Vienna is now processing March waivers. Several who have filed in March have received their answers. Anyone else heard this?
I emailed Vienna myself last week and still haven't heard back. How long do they usually take to respond?

Hi all, Just emailed my lawyers office to see if they have heard from Vienna.
this is the email i received.
"As far as I know, Vienna is still working on applications received in February 2008. In addition, the adjudicating officer left Vienna in early July for a two-month training session in the U.S. This means that, although the applications are being reviewed, final decisions may be delay by two months."

Does this two month delay mean that instead of processing being six months, it will now be eight for everyone who has already mailed their waivers?

I'm not sure. I called and talked to my lawyer today and it was stated that the adjudicating officer mit be back in the begging of September. I think at that point the cases will be finished then when she returns to Vienna. Sorry for the bad news just wanted to let everyone. Good Luck to us all.

I spoke with Vienna today. They are still in February. However, they said that despite any training going on etc., they will continue to maintain their 6 month processing time.

GeniAna, I got a email from my lawyer say the samething about Vienna still working on Feb. , and that the Officer in Charge should be back in Vienna by the end of Aug or the begging of Sept. I'm glad to hear that they are maintaining their 6 month processing time.

One of the assistant emails Mr Stettner all the time to check up on cases that they have filed so she can tell us whats going on. I hope thay have started March, and i hope the Officer in Charge is back in the office now.

Hi Vala2008, my Albanian husband and I filed our I130 in July of 2007 and the I129F in September in 2007. In March we got approval notices from both within the same week. This was within the normal guidelines..so it took about 7 months. Within 4 more months we had our interview. There is a website where you can check what month the USCIS is currently working on for these documents. https://egov.uscis.gov/cris/jsps/index.jsp

Hi everyone, I Received a letter from my lawyers office today. I will be going in to see him on Monday morning. I have tryed to attach a cope of the denial letter to this but was not able to. It looks like we have three options, Do nothing, Appeal, or Refile. I think we are going to try and Appeal, but my husband and i have to talk more about it. I will keep you updated as soon as we know what we are going to do. Thanks again for all of your support.

Dear Ms. Pishev,
Unfortunately we cannot make any statements about the future adjudication schedule. We are currently still working on the May cases, but it is not possible to predict when June adjudication will start as it depends on different factors (number of cases, type of cases, availability of adjudicator etc.)
Our office is only closed on weekends and for official local and U.S. holidays.

Can someone tell me their experience with Reapply for waivers through Belgrade and Vienna??? How long does the whole process take again?? I've heard that when reapplying it's not their priority as those who file for the first time.

If you refile then it takes the same amount time as the first time, you just have to go back to the end of the line and wait again, in Vienna it would be another 5-6 months.

No I'm in the States at this time. I found my job online. It toke a few weeks and a lot of time online but i found a job. No they are not paying for my move. As far as i know that is only done when you have a C level skill job.
You should look up some info on cic.gc.ca you will find a lot of info to help you. Where are you looking to move in Canada? Good luck

i'm working on getting my work permit, because the job offer i have is a O type job skill my husband will br given a work permit as well all i have to file for him is the TRV once that is approved he can come right over and meet me in Canada. You can email them, and they will get back to you, it usually takes about 30 days before they put it waiver in the system.

I waited one month from the date of the interview in Tirana before I checked in with Vienna. When I emailed them, I included my husband's case number he had in Tirana, his full name, and birthday. I think even just the name and birthday will be enough.

I cannot even imagine finding something like that out... There is no excuse for that, the separation is hard on both parties, does not give a license to cheat. I guess you have to go with what your gut tells you.. some people can get past that- I don't know that I could.

I emailed DHS Vienna and they said they still haven't received my paperwork. I'm so upset, it just keeps getting pushed back and pushed back and I feel so helpless. If they don't have it there's nothing I can do :( Its been a month and half, any suggestions? ......... super bummed

I would contact the U.S. Embassy in Tirana and ask them if they've mailed it out yet. If they mailed it a while ago, then you need to get the DHL/UPS tracking number and make sure your packet hasn't gotten lost in the mail. Most likely Tirana still has it, and things may be running slow because of the holidays; but give them a call or email just to make sure.

Optimistic... I would still try to get the tracking number... It may not be in the system yet.. With mine we requested it to be expedited, that is why it may have been put in the system faster... FYI for anyone who has an expedition in Vienna, they will no longer except an expedited waivers.... That is what I was told by Vienna...
